_I <br />BOCK 41 PAGE 3Q3 <br />FURTHER NOTED THAT THEY HAVE GONE A LONG WAY ON THE SHOPPING CENTER WITH <br />NO WATER AND SEWER FRANCHISE. <br />MR. RIGLER STATED THAT ONE OF THE MAIN REASONS THEY STOPPED <br />SHORT OF THE DRI THRESHOLD WAS BECAUSE OF THE COST INVOLVED IN A DRI <br />APPLICATION AND FELT 64 ACRES TO DEVELOP WOULD ALLOW AROUND 720 UNITS. <br />HE STATED THAT THEY HAVE TALKED TO THE ADMINISTRATOR ABOUT A WATER AND <br />SEWER FRANCHISE. <br />ADMINISTRATOR JENNINGS COMMENTED THAT THEY WERE TOLD THEY HAD <br />TO HAVE A FRANCHISE. <br />DISCUSSION FOLLOWED IN REGARD TO ON-SITE RETENTION, AND <br />COMMISSIONER LYONS ASKED IF THEY WERE THE SAME GROUP CLEARING THE SHOP- <br />PING CENTER WHOSE PLAN DID NOT INCLUDE THE PRESERVING OF AN 150 YEAR <br />OLD OAK TREE. <br />MR. RIGLER STATED THAT THEY DID HAVE THE URBAN FORESTER COME <br />TO MARK THE TREES, HE FELT SOMETIMES THESE TREES COME DOWN BY ACCIDENT <br />WHEN YOU ARE USING HEAVY EQUIPMENT AND POSSIBLY THE TREE WAS DISEASED. <br />COMMISSIONER SIEBERT ASKED IF THEY HAVE A COPY OF THE HYDROLO- <br />GIST S REPORT, AND MR. RIGLER STATED THAT THEY WOULD BE HAPPY TO FURNISH <br />ONE BUT HE DID NOT HAVE A COPY WITH HIM. HE NOTED THAT VISTA ROYALE <br />IS HITTING THE SAME STRATA THEY ARE AND HE BELIEVED THEY ARE NOT HAVING <br />ANY PROBLEMS. <br />PLANNING DIRECTOR REVER AGREED THAT THE PLANNING & ZONING <br />COMMISSION SUGGESTED R -2B, BUT THE PLANNING STAFF STILL FEELS R -2C WOULD <br />BE REASONABLE. HE NOTED THAT IF YOU TAKE THE VISTA ROYALE REAL DENSITY, <br />EXCLUDING THE GOLF COURSE, IT DOES FALL AT 11. SECONDLY, ANY NEW <br />DEVELOPMENT IS GOING TO IMPOSE ON THE ENTOMOLOGICAL LABORATORY. HE <br />FELT THE LABORATORY IS CONCERNED WITH DEVELOPMENT IN ANY FORM, AND <br />FURTHER THEY HAVE INDICATED THEY CAN AND WILL SEEK OTHER LANDS, MR. <br />REVER WAS OF THE OPINION THAT THE DRI IS NOT SUPERSEDED; IT IS 750 AS <br />A NUMBER BUT IT HAS BEEN TESTED IN THE COURTS THAT THIS NUMBER IS FLEXIBLE. <br />HE FURTHER POINTED OUT THAT THIS PROJECT STILL HAS TO GO THROUGH SITE <br />PLAN APPROVAL AND BECAUSE OF THE SIZE OF THE PROJECT IT WILL MOST <br />PROBABLY GO BEFORE THE TECHNICAL REVIEW COMMITTEE BECAUSE OF THE NATURE <br />
