r <br />AUG 8 1979 41 FAcr 305 <br />THE AREA NEEDS PUBLIC SERVICES AND DRAINAGE BEFORE THERE IS ANY PROLIF- <br />ERATION OF DEVELOPMENT AND THAT IT IS PREMATURE TO CHANGE TO A HIGH <br />DENSITY AT THIS TIME. <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />SIEBERT, TO DENY THE REQUEST FOR REZONING TO R -2C ON THE BASIS THAT IT <br />IS PREMATURE FOR THE REASONS GIVEN BY ALL THE COMMISSIONERS. <br />MR. CONNERY POINTED OUT THAT VISTA ROYALE IN THE LAST FEW <br />MONTHS HAS SOLD 450 UNITS, AND HE DOES NOT FEEL THAT THE PROPOSED DEVELOP- <br />MENT IS IN ANY WAY PREMATURE. HE STATED THAT HE ALSO RESENTS BEING IN <br />COMPETITION WITH A STATE AGENCY. MR. CONNERY FELT THERE IS A DEFINITE <br />NEED FOR SUCH A DEVELOPMENT AND STATED THEY ARE WILLING TO BACK OFF TO <br />S UNITS PER ACRE, BUT TO REFUSE A DEVELOPMENT BECAUSE IT IS PREMATURE <br />THAT IS A JUDGMENT CALL. HE ASKED WHY THE BOARD IS GOING AGAINST THEIR <br />COMPREHENSIVE PLAN. <br />COMMISSIONER SIEBERT EXPLAINED THAT IS MEANT FOR THE FUTURE <br />OR LONG RANGE DEVELOPMENT OF THE COUNTY. <br />THE CHAIRMAN CALLED FOR THE QUESTION. IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY. <br />ATTORNEY SHERMAN SMITH, JR. NEXT CAME BEFORE THE BOARD TO <br />DISCUSS HIS REQUEST FOR ABANDONMENT OF A RIGHT-OF-WAY OBTAINED FROM <br />HOWARD CAIL WHERE 43RD AVENUE INTERSECTS STATE ROAD 5 (U.S. 1) IN THE <br />VICINITY OF HOBART LANDING. HE NOTED THAT THIS WAS OBTAINED FROM MR. <br />CAIL IN 1960 WHEN THEY WERE GOING TO FOUR -LANE U.S. 1, AND CURB AND <br />GUTTER CONSTRUCTION WAS CONTEMPLATED. THIS PROPERTY IS NOT ON U.S. 1; <br />THE CURB AND GUTTER CONSTRUCTION WAS NEVER DONE; AND THE PROPERTY SERVES <br />NO USEFUL PURPOSE. MR. GAIL, THEREFORE, WOULD LIKE TO HAVE IT BACK, <br />ATTORNEY SMITH INFORMED THE BOARD THAT HE WROTE THE DOT REQUESTING THAT <br />THIS BE DEEDED BACK TO MR. GAIL, AND THEY HAVE REFERRED THE MATTER TO THE <br />COUNTY BECAUSE THEY WILL ONLY ABANDON IF THE COUNTY HAS NO OBJECTION. <br />A ROAD. <br />ADMINISTRATOR UENNINGS STATED THAT WE DO NOT NEED THIS FOR <br />ASSISTANT PLANNER DAVID MARSH NOTED THAT WHEN HE REVIEWED <br />THIS AND RECOMMENDED DISAPPROVAL, HE WAS UNAWARE OF ALL THE FACTS AND <br />
