u <br />WENDY LANCASTER OF THE PLANNING DEPARTMENT INFORMED THE <br />BOARD THAT THE SUBJECT PROPERTY IS APPROXIMATELY 13 ACRES IN SIZE AND <br />IS LOCATED WEST OF 43RD AVENUE SOUTH OF NORTH GIFFORD ROAD, THE AP- <br />PLICANT, GORDON CHAFFEE, ORIGINALLY REQUESTED REZONING OF THE NORTH- <br />EAST 1-1/2 ACRES WHERE HE WISHED TO PUT HIS MINI -WAREHOUSES, BUT THE <br />PLANNING & ZONING COMMISSION INITIATED THE REZONING OF THE ENTIRE <br />PARCEL WHICH IS PRESENTLY ZONED R-2. MS, LANCASTER CONTINUED THAT <br />THE PLANNING STAFF RECOMMENDS APPROVAL OF THIS REZONING TO ESTABLISH <br />CONSISTENCY IN THIS AREA WHICH IS PRIMARILY INDUSTRIAL IN NATURE, <br />COMMISSIONER DEESON ASKED HOW MANY RESIDENCES ARE INVOLVED, <br />AND MS. LANCASTER BELIEVED THERE ARE A.DOZEN OR SO, SHE NOTED THAT <br />THEY HAVE RECEIVED NO OBJECTIONS FROM THE PROPERTY OWNERS. <br />VICE CHAIRMAN LOY ASKED IF ANYONE PRESENT WISHED TO BE HEARD, <br />LEONARD WEBB INFORMED THE BOARD THAT HE BOUGHT AN SO X 100 <br />LOT FROM MRS, JORDON JUST THIS MONTH. HE NOTED THAT IT IS JUST A <br />SMALL LOT AND IT HAS A HOUSE ON IT. HE STATED THAT IF THIS IS ZONED <br />COMMERCIAL HE DOES NOT OWN ENOUGH PROPERTY TO BUILD A BUSINESS ON IT, <br />AND HE WOULD LIKE TO KEEP IT JUST LIKE IT IS. <br />VICE CHAIRMAN LOY NOTED THAT THE NOTICE WAS SENT TO DELIA <br />JORDON SINCE MR. WEBB JUST PURCHASED THIS PROPERTY. <br />ATTORNEY COLLINS INFORMED MR, WEBB THAT HE COULD STILL USE <br />HIS PROPERTY FOR RESIDENTIAL PURPOSES, BUT IF IT WERE BURNED DOWN, <br />IT COULDNIT BE REBUILT, ATTORNEY COLLINS COMMENTED THAT HE HAS A <br />PROBLEM WITH <br />THE <br />NOTICE BECAUSE THE PROPERTY <br />HAS CHANGED <br />HANDS <br />AND <br />THE PRESENT <br />OWNER <br />DID NOT RECEIVE NOTICE. <br />HE FELT THE <br />NOTICE <br />IS <br />VALID, HOWEVER, BECAUSE IT WAS SENT TO THE LAST OWNER OF RECORD ON <br />THE TAX ROLL. HE ASKED MR. WEBB IF MRS, CORDON FROM WHOM HE BOUGHT - <br />THIS PROPERTY HAD INFORMED HIM THAT IT WAS BEING REZONED. <br />MR. WEBB STATED THAT SHE DID NOT. <br />MR, NEDELL, OWNER OF PROPERTY IN THIS AREA, SHOWED THE BOARD <br />WHERE HE IS LOCATED ON 45TH AVENUE RIGHT BEHIND MR. RODDENBERRY, AND <br />STATED THAT HE DID NOT OBJECT TO REZONING OF THE SMALL PARCEL ORIGI- <br />NALLY REQUESTED, BUT HE DID OBJECT TO REZONING THE WHOLE AREA. <br />39 <br />
