about 14% above the appraised value, which would be made in mitigation of attorney's fees in <br />eminent domain. <br />Attorney DeBraal responded to concerns over future expenses and he explained the <br />details of the appraisals. <br />County Attorney Collins further explained the details of going to court in eminent <br />domain as well as the specifics of the appraisals. He acknowledged that staff is trying to avoid <br />certain expenses of trial by making the best offer and keeping the cost down. <br />In response to Commissioner Wheeler's query, Attorney DeBraal affirmed that 7.39 <br />acres would need to be purchased for the right-of-way, and he emphasized the reasons. <br />ON MOTION by Vice Chairman Davis, SECONDED by <br />Commissioner Flescher, the Board unanimously approved <br />Resolution 2008-031, declaring a reasonable necessity to <br />acquire certain real property for the purposes of improving <br />and reconstructing 66th Avenue, including side street, <br />intersection and water retention pond improvements; <br />authorizing the County Attorney to acquire the attached <br />properties by the institution of proceedings in eminent <br />domain, and providing an effective date. <br />13.
