ATTORNEY BLOCK <br />STATED THAT HE HAD ASKED MR. PRICE OF GLOBAL PAVING HOW THE WORK THEY <br />HAVE DONE COULD BE REMEDIED, AND MR. PRICE INFORMED HIM THAT TO <br />REMEDY THE SITUATION, THEY WOULD HAVE TO TAKE OUT THE CULVERT AND <br />REDO THE BANKS, ETC., WHICH WOULD COST ABOUT $500. ATTORNEY BLOCK <br />CONTINUED THAT THEY ARE BEFORE THE COMMISSION TODAY TO STATE THAT <br />THEY DO NOT REQUEST THAT THIS ROAD BE CUT THROUGH INTO COLONIAL <br />TERRACE, BUT THEY DO FEEL THERE SHOULD BE SOME DISCUSSION ABOUT WHO <br />IS GOING TO PAY TO PUT THIS BACK THE WAY IT WAS. HE NOTED THAT IF <br />THEY WERE NOT REQUIRED TO DO THIS AS THEY HAD THOUGHT, THEY DO NOT <br />FEEL THEY SHOULD HAVE TO BEAR THIS COST. <br />JOHN COLLINS, PRESIDENT OF THE COLONIAL TERRACE SUBDIVISION <br />PROPERTY OWNERS' ASSOCIATION, INFORMED THE BOARD THAT THE CULVERT HAS <br />BEEN INSTALLED, AND FROM WHERE THE CULVERT WAS INSTALLED UNTIL YOU <br />GET DOWN TO DR. AND MRS. HILLS PROPERTY, THE PAVING HAS BEEN TAKEN <br />OUT, MR. COLLINS FELT THE CULVERT HAS TO BE REMOVED, THE SWALE RE- <br />DONE, THE PAVING REPLACED THAT WAS RIPPED OUT, AND TREES REPLACED, <br />OR MOTORCYCLISTS WILL GO THROUGH THERE. <br />COMMISSIONER SIEBERT ASKED ENGINEER SCHMUCKER WHAT LED <br />THEM TO BELIEVE THE ROAD SHOULD BE CUT THROUGH. <br />ENGINEER ED SCHMUCKER STATED THAT FORMER PLANNING DIRECTOR <br />VAL BRENNAN WANTED THE STREETS CONNECTED, AND HE BELIEVED THERE HAD <br />BEEN COMMENTS MADE ABOUT CIRCULATION THROUGH THE SUBDIVISION. HE <br />CONTINUED THAT HE HAD FELT IT WAS INTENDED THAT THE STREETS SHOULD <br />BE CONNECTED AND NOTED THAT WHEN THEY TOOK THE ORIGINAL BIDS ON <br />THIS SUBDIVISION, THERE WAS SPECIFIC INSTRUCTION ABOUT THE SIZE OF <br />THE CULVERT AND THE FACT THAT THE PAVEMENT IN COLONIAL TERRACE WAS <br />SOME 60' NORTH OF THE PROPERTY LINE SO THE CONTRACTOR WOULD NOT <br />- FALL INTO THE TRAP OF THINKING THAT HE ONLY HAD TO GO TO THE MITCHELL <br />_SUBDIVISION PROPERTY LINE. MR.-SCHMUCKER NOTED THAT THE COUNTY HAS <br />OCT 101979 59 Boa 41, PACE 687 <br />
