COMMUNITYDEVELOPmENT <br />APPEAL BY I AM MINISTRIES, INC (THE SOURCE) OF A DECISION BY <br />THE PLANNING & ZONING COMMISSION TO UPHOLD AN APPEAL BY <br />STEVEN & ERIN METZ AND OVERTURN A DECISION BY COMMUNITY <br />DEVELOPMENT STAFF THAT THE NON -CONFORMING RESIDENTIAL <br />TREATMENT CENTER USE AT 5925 37TH STREET DID NOT CEASE FOR <br />MORE THAN ONE YEAR AND THAT THE USE MAY CONTINUE UNDER <br />DIFFERENT OWNERSHIP (QUASI-JUDICIAL) <br />Chairman Bowden requested that all potential speakers be sworn, pursuant to quasi- <br />judicial requirements. The Deputy Clerk administered the Oath. <br />COUNTYSTAFF'S PRESENTATION <br />Planning Director Stan Boling recapped the backup memorandum dated April 17, 2008 <br />and updated the Board on the request for a nonconforming residential treatment center use at <br />5925 37th Street. He provided detailed background and reminded the Board of previous <br />consideration and decisions regarding this matter. <br />Community Development Director Bob Keating displayed the County land -use map, <br />outlining the subject site and surrounding communities, with their respective zonings. He said <br />the historical use and zoning for the subject site are different from surrounding properties on this <br />site.
