To show that these entities are completely separate and independent of each other and <br />have been since the year 2000, Attorney O'Haire submitted into the record a Report from the <br />Secretary of State's Office, which described Alcohope as a separate and independent entity from <br />New Horizons of the Treasure Coast, whose principal address is 4500 West Midway Road, Fort <br />Pierce, Florida and as of 2008, the address of Alcohope is 3395 11th Court. <br />(Clerk's Note: entered into evidence by Attorney O'Haire, Exhibits I & 2 — copies of the <br />registration with the Florida Department of State, Division of Corporations, for Alcohope of the <br />Treasure Coast, Inc., and New Horizons of the Treasure Coast, Inc.) <br />Attorney O'Haire alluded that what has to be shown in order to terminate a <br />nonconforming use is an intentional abandonment of a piece of property, and suggested to the <br />Board that they are able to show that, in the case of Alcohope. He presented a copy of the Lease <br />Agreement between Alcohope of the Treasure Coast, Inc., and Health Systems of Indian River, <br />Inc., (Exhibit 3) and called attention to certain provisions of said contract which he deemed were <br />significant to whether or not there was a legitimate grandfathering that The Source can <br />piggyback on. <br />(Clerk's Note: entered into evidence by Attorney O'Haire, Exhibit 3 — Lease Agreement <br />between Health Systems of Indian River, Inc., and Alcohope of the Treasure Coast, Inc. ) <br />Attorney O'Haire argued the issues of Alcohope's contractual obligation to build, and <br />its intent and commitment to move the facility from 37th Street. He pointed to the Lease <br />Agreement [page 5 (c) ] that states that the Treatment Center shall be completed and a certificate <br />of occupancy for the Treatment Center shall be issued and received no later than the 1St day of <br />September, 2004. Therefore, he discerned, if things had gone according to plan they would <br />have been in their new facility before Hurricanes Frances and Jeanne hit the County. <br />April 24, 2008 35 <br />Special Call Meeting (The Source) <br />
