INDIAN RIVER COUNTY <br />BOARD OF COUNTY COMMISSIONERS <br />ADMINISTRATIVE GUIDELINES <br />Title: Vacating or Abandonment of <br />Publicly Dedicated Rights -of - <br />Way and Easements or Alleys <br />Date: <br />COUNTY ABANDONMENT AND EASEMENT RELEASE PROCEDURES <br />1. PURPOSE AND SCOPE <br />A. To establish the procedures necessary for the public and county to <br />initiate action for vacating rights-of-way, easements and alleys, <br />dedicated to public use. <br />B. To provide the public with the steps needed to be taken for abandon- <br />ment and closing procedings. <br />II. DEFINITIONS AND REFERENCES <br />A. Petitioner or Applicant - person or persons submitting a petition. <br />B. Petition to Vacate or Abandon a Street,, A�y�y, or Easement - <br />Tinitiated by pubic - Form used by the public to request the county <br />to vacate a street, alleyway, or easement (exhibit 1). <br />C. Legal Notice No. 1 - The notice that -appears in a newspaper setting the <br />date for the public hearing on the proposed closing of a street, road or• <br />alleyway. Certification of Publication required. <br />D. Resolution - Initiated by the Board of County Commissioners at the public <br />hearing. This applies to the actual closing of a street, road, alleyway, <br />or easement release. <br />E. Reviewing Agency's Reply Form (see attached fortis) <br />F. Legal Notice No. 2 - notice published in a newspaper, advertising the <br />actual closing of a street, road or alleyway, as approved and directed by <br />the Board of County Commissioners. Certification of Publication required. <br />G. Abutting Property Owner's Reply Form - (see attached form) <br />Legal Authority: Florida Statutes, Chapters 177 and 336.09 & 10. <br />III. POLICY <br />A. Public rights -of -ways or easements may be vacated or abandoned by petition <br />initiated by the public, or by action initiated by the Board of County <br />Commissioners. <br />B. All petitions submitted by the public shall be addressed to: <br />Board of County Commissioners, Indian River County <br />Attention: Planning and Zoning Department <br />2121 14th Avenue <br />Vero Beach, Florida 32960 <br />C. It shall be the responsibility of the petitioner to submit the petition <br />with an accurate legal description of the property to be vacated (see <br />exhibit 1). <br />D.
