NOV 71979 <br />IV. PROCEDURES <br />A. Petitioner <br />4 <br />am 42 PAGE 34 <br />1) The petition (exhibit 1) shall be used by the public when requesting <br />the Board of County Commissioners to vacate or abandon rights-of-way, <br />alleys or easements dedicated to public use. <br />2) The petitioner shall provide an accurate legal description of rights- <br />of-way, alleys or easements on the petition. An accurate legal de- <br />scription may be obtained from the Clerk of the Circuit Court (Recording <br />Department). If the alley, easement or right-of-way is in a subdivision, <br />petitioner shall provide a copy of the subdivision plat. <br />3) The petitioner shall also provide a Certificate of Ownership issued by <br />a practicing attorney or by a title company. <br />4) The petition shall bear the signature and address of the petitioner <br />and list the property owners (if any) abutting that portion of the <br />public right-of-way or easement requested to be vacated. <br />5) The petition shall be addressed to the Board of County Commissioners, <br />Attention: Planning and Zoning Department, Indian River County Court- <br />house, Vero Beach, Florida, 32960. <br />B. Fees and Costs for Administration, Advertising,and Recording <br />1) Street and Alley Abandonments, etc. <br />a) A $100.00 fee for recording and administrative costs shall <br />accompany the petition and attachments. The check should be <br />made payable to the Board of County Commissioners. <br />b) The petitioner shall also pay the costs incurred in publishing <br />the required notices in a newspaper of general circulation. Fee <br />receipts and publication certification copies shall be included <br />as a part of the documentation to be presented to the Board at <br />the actual public hearing. <br />2) Easement Releases <br />a) A $75.00 fee shall be paid for recording and administrative costs <br />when petitioning for an easement release. The $75.00 fee can <br />apply for up to 2 (two) easement releases if in the same sub- <br />division and unit. <br />b) Easement releases on a series of contiguous lots (up to 4 lots <br />in same Block, Unit and Subdivision) will be considered a single <br />request requiring a $75.00 fee. If a request involves several <br />easement releases within a single subdivision, then an additional <br />$25.00 fee will be charged for every 2 additional easements. <br />Generally one petition (application) form should be adequate for <br />multiple easement release requests. <br />A. Review Procedure Plannin _and Zoning Department <br />1) Upon receipt of the completed petition,.fee(s), and related maps, <br />etc., the Planning and Zoning Department will: <br />a) Furnish a copy of the petition with a general description or <br />tax map, and reply form to all applicable reviewing agencies, <br />departments, or utility providers. Said petition forms, etc. <br />will be forwarded within 5 days of receipt, with a return reply, <br />suspension date of 20 days from the official filing date of the <br />application. <br />-2- <br />_ M <br />
