NOV 2 11979 <br />BOCK 42. PAGE 103: <br />RICHARD LETSINGER, DEVELOPER, COMMENTED THAT HE SAW <br />NO OBJECTION TO HAVING A COUPLE OF SOIL TEST BORINGS DONE. <br />COMMISSIONER LYONS INTERJECTED THAT IT WOULD BE GOOD <br />INSURANCE FOR THE DEVELOPER. <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY <br />COMMISSIONER SIEBERT, FOR TENTATIVE APPROVAL OF TURTLE COVE SUB- <br />DIVISION, WITH THE UNDERSTANDING THAT THE DEVELOPER WILL HAVE <br />SOIL TESTING TO A DEPTH OF 6' OR THE WATER TABLE, WHICHEVER IS <br />THE LESSER, AS A CONDITION OF APPROVAL OF THIS SOIL TEST. <br />ATTORNEY COLLINS SUGGESTED HE ADD TO THE MOTION THAT, <br />IN THE EVENT THE HEALTH DEPARTMENT DETERMINES THE TEST IS UNSATIS- <br />FACTORY, THE DEVELOPER SHALL BUILD A SEWER PLANT ADEQUATE TO <br />SERVICE THE PROPERTY PRIOR TO FINAL APPROVAL. HE CONTINUED THAT <br />HE IS CONCERNED THAT IF THERE IS TENTATIVE APPROVAL WITHOUT THE <br />REQUIREMENT OF SOIL APPROVAL, THE BOARD MAY FIND ITSELF BOUND TO <br />GRANT FINAL APPROVAL. ATTORNEY COLLINS STATED HIS CONCEPT IS TO <br />BE AS CLEAR AS POSSIBLE IN GRANTING TENTATIVE APPROVAL; THE MOTION <br />IS SATISFACTORY BUT FELT THE ALTERNATIVES SHOULD BE MENTIONED. <br />MR. LETSINGER STATED THAT HE WOULD LIKE TO HAVE THE <br />RIGHT TO WITHDRAW AS HE DIDNIT WANT TO BE COMPELLED TO DEVELOP <br />AND BUILD A SEWER PLANT. <br />.JAMES FOWLER, SURVEYOR, REPORTED THAT THEY HAVE THE SOIL <br />TEST BORING AND WOULD BE GLAD TO TURN IT OVER TO THE HEALTH <br />DEPARTMENT. <br />COMMISSIONER LYONS WITHDREW HIS MOTION, AND COMMISSIONER <br />SIEBERT WITHDREW HIS SECOND. <br />COMMISSIONER Loy SUGGESTED, IN ORDER TO BE CONSISTENT, <br />THE PLANNING DEPARTMENT BE DIRECTED TO GIVE THE BOARD A POLICY TO <br />dmiull f <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY GRANTED TENTATIVE APPROVAL OF THE <br />TURTLE COVE SUBDIVISION UPON THE SATISFACTORY EVIDENCE THAT THE <br />DEVELOPER MEETS THE REQUIREMENTS OUTLINED IN THE MEMORANDUM OF <br />NOVEMBER 1, 1979 FROM JACK ALLEN OF THE HEALTH DEPARTMENT. <br />
