ON MOTION by Commissioner Macht, SECONDED <br />by Commissioner Neuberger, by a 4-0 vote, <br />Commissioner Adams absent, the Board unanimously <br />found that in conjunction with the recommended <br />conditions: 1) It is empowered under the provisions of <br />Chapter 971 to review the special exception use <br />applied for; 2) The granting of the special exception <br />use will not adversely affect the public interest; and 3) <br />The application satisfies the general and specific <br />criteria required for special exception approval. <br />Further, the Board granted the special exception and <br />major site plan approval for the proposed place of <br />worship with the following conditions: 1) Prior to site <br />plan release the applicant shall (a) dedicate, without <br />compensation, 10 feet of right-of-way along the site’s <br />th <br />entire 9 Street SW frontage; (b) submit funds to the <br />county for the construction of the required 8-foot wide <br />th <br />sidewalk along the site’s 9 Street SW frontage; and <br />(c) establish a conservation easement over the 0.554 <br />acres of uplands being preserved on the site, as <br />depicted on the site plan, and 2) prior to issuance of a <br />certificate of occupancy for phase one, the applicant <br />will be required to install all perimeter landscape <br />buffers, all as recommended in the memorandum of <br />May 11, 2004. <br /> <br />May 18, 2004 <br />11 <br /> <br />
