In response to Vice Chairman Wheeler’s inquiry, County Attorney Collins advised that was <br />a legal and a planning opinion. <br /> <br />There were no additional speakers and the Chairman closed the public hearing. <br /> <br />Commissioner Davis thought the Commission needed to be careful of creating enclaves <br />inside the USA and what the Legislature might require locally if an enclave is created. He believed <br />the Board needed to address this concern for all of the packinghouses and, more importantly, the <br />Board should not allow another packinghouse to move out west just to circumvent our USA or <br />zoning requirements. <br />Commissioner Bowden pointed out that this parcel is under discussion and felt that in <br />order to keep the revenue and jobs it would be simplest and best to move the USA. <br />Commissioner Lowther believed this request made common sense and agreed with <br />Commissioner Bowden. He thought with the prospect of Oslo Road having 5-lanes, an I-95 <br />interchange at Oslo, and with the Landfill nearby the area was unlikely to be developed for <br />housing. <br />Chairman Neuberger agreed with staff’s recommendation and with Commissioner <br />Bowden. The other packinghouses may or may not become an issue he said. He understood this <br />one should have been inside the USA since the beginning. <br />Commissioner Lowther commented that he understood that the Legislature’s intent <br />regarding enclaves had to do with residential and not commercial. <br /> <br />MOTION WAS MADE by Commissioner Lowther, <br />SECONDED by Chairman Neuberger for further <br />discussion, to approve staff’s recommendation as <br />submitted. <br /> <br />May 2, 2006 <br />20 <br /> <br />
