THE CHAIRMAN FELT WE WANT TO AUTHORIZE THE ATTORNEY TO SET <br />UP THE PROCESS, BUT NOT DETERMINE WHETHER WE WANT TO ABANDON THE <br />PROPERTY OR NOT AT THIS TIME. <br />COMMISSIONER LYONS' MOTION DIED FOR LACK OF A SECOND. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY AUTHORIZED THE INTERGOVERNMENTAL <br />COORDINATOR TO HAVE THE SUBJECT PROPERTY APPRAISED AND THIS MATTER <br />BROUGHT -BACK TO THE BOARD FOR FURTHER CONSIDERATION. <br />FRANK ZORC CAME BEFORE THE BOARD TO DISCUSS HIS REQUEST <br />TO DIVIDE LOTS #1 AND #7 OF ORANGE TERRACE SUBDIVISION INTO TWO LOTS. <br />HE STATED THAT SINCE PLACING THIS MATTER ON THE AGENDA, THEY HAVE <br />ENCOUNTERED A FURTHER PROBLEM AND NEED CLARIFICATION AS TO.HOW THEY <br />MIGHT BE ABLE TO USE THEIR LOTS IN ORANGE TERRACE AND COMPLY WITH <br />THE ORDINANCE. HE EXPLAINED THAT THEIR PROPERTY WAS DEVELOPED OVER <br />A YEAR AGO INTO LOTS CONTAINING ALMOST 3/4 OF AN ACRE EACH, WITH THE <br />UNDERSTANDING AND APPROVAL OF THE STATE HEALTH DEPARTMENT THAT THEY <br />COULD BUILD S TO 10 UNITS ON THESE LOTS WITH SEPTIC TANKS AND WELLS. <br />THIS, HOWEVER, WAS CHANGED, AND THEY WERE TOLD THAT THEY COULD NOT <br />USE SEPTIC TANKS, SO THEY THEN REQUESTED USE OF THE SEWER LINE ON <br />6TH AVENUE. MR. ZORC CONTINUED THAT THE BOARD SAW FIT TO LIMIT THEM <br />TO ONLY FOUR UNITS AND ONE WELL PER LOT, AND THEY THEN CONCLUDED THAT <br />THEY WOULD HAVE TO GO IN TO THE WATER BUSINESS. THEY RECENTLY HAVE <br />BEEN ADVISED THAT PRIVATE WATER SYSTEMS WOULD COST ABOUT $75,000, <br />AND HIS INVESTORS HAVE DECIDED THERE IS NO WAY THEY CAN AFFORD THIS <br />AMOUNT, ESPECIALLY SINCE THEY ARE GOING TO SPEND $40,000 FOR SEWER <br />CONNECTION. MR. ZORC STATED THAT HE REALIZED HIS REQUEST TODAY <br />PERTAINS TO LOTS #1 AND #7, BUT HE REQUESTED THAT THE BOARD ADVISE <br />THEM IF THEY CAN TAKE AND USE THE LOTS FROM THE PAVED ROAD ON BACK <br />ONLY DEEP ENOUGH TO PERMIT THEM TO BUILD A FOUR UNIT APARTMENT BUILDING <br />AND NOT USE THE BALANCE OF THE LOT FOR A PERIOD OF TIME WITH THE IDEA <br />THAT WHEN THE COUNTY COMES IN WITH THE WATER SYSTEM, THEY THEN CAN <br />USE THE REMAINING PROPERTY TO DEVELOP SEPARATELY WITH A SITE PLAN. <br />HE'STATED THAT THEY CAN MEET THE SITE PLAN REQUIREMENTS AND HAVE <br />DEC 191979 <br />BOOK . 42PAGE 387 <br />
