I <br />JAN 91980 BODK 42 PAGE 504 <br />ATTORNEY COLLINS REQUESTED THAT MR. REVER COMMENT ON THE <br />VOTE OF THE PLANNING & ZONING COMMISSION ON THIS MATTER. <br />MR, REVER EXPLAINED THAT MR. D. B. SMITH, THE NEWEST <br />MEMBER OF THE PLANNING & ZONING COMMISSION, OWNS LAND NEAR THE SITE <br />IN QUESTION AND FELT IT MIGHT BE A CONFLICT OF INTEREST. ATTORNEY <br />BROWN DID NOT FEEL THERE WAS A CONFLICT OF INTEREST, BUT MR. SMITH <br />DECIDED NOT TO VOTE ANYWAY, AND IT APPEARS AS AN ABSTENTION. <br />ATTORNEY COLLINS COMMENTED THAT THE COMMISSION HAS NOT HAD <br />AN APPEAL OF A SITE PLAN SINCE THE ORDINANCE WAS REDRAFTED. THE <br />ORDINANCE READS THAT NOTICE WILL BE GIVEN IN A MANNER SATISFACTORY <br />TO THE BOARD. HE ASKED IF THE BOARD WAS SATISFIED THAT THE AGENDA, <br />WHICH IS AVAILABLE TO THE.PRESS, IS SATISFACTORY NOTICE. HE FELT <br />THAT WE NEEDA STANDARD TO GO BY. <br />PLANNING DIRECTOR REVER STATED THAT THE PLANNING DEPARTMENT <br />IS PREPARED TO GO ALONG WITH THE PROCESS AND HAS ALL THEIR MATERIAL, <br />BUT HE WOULD LIKE TO HAVE A KNOWN PROCEDURE IN ORDER TO BE ABLE TO <br />INFORM THE APPLICANT AND TO BE SURE THEMSELVES EXACTLY HOW TO PROCEED. <br />SENIOR PLANNER MARSH ALSO FELT THERE IS A NEED TO ESTABLISH <br />A NOTIFICATION PROCESS FOR SITE PLAN APPROVAL APPEALS. <br />COMMISSIONER LYONS WAS OF THE OPINION THAT THIS IS JUST <br />A NORMAL NEXT STEP IN THE WHOLE PROCESS AND FELT IT IS CONSISTENT <br />WITH OUR OTHER PROCEDURES. <br />COMMISSIONER WODTKE EXPRESSED CONCERN ABOUT REACHING <br />SURROUNDING PROPER OWNERS IF IT WERE A LARGE SITE PLAN WHICH WOULD <br />HAVE A GOOD DEAL OF IMPACT, BUT COMMISSIONER LYONS NOTED THAT THE <br />MINUTES ARE AGENDAED AND ARE PUBLIC. <br />PLANNING DIRECTOR REVER ALSO POINTED OUT THAT ANYTHING OF <br />THAT MAGNITUDE GOES BEFORE THE SUBDIVISION REVIEW COMMITTEE AND HAS <br />TECHNICAL INPUT ALONG THE WAY. <br />IN FURTHER DISCUSSION, IT WAS NOTED THAT OCCASIONALLY THE <br />ZONING BOARD HAS DECIDED THAT A PARTICULAR MATTER SHOULD HAVE A <br />PUBLIC HEARING AND CALLS FOR IT EVEN THOUGH PROCEDURE DOES NOT <br />REQUIRE IT. <br />
