Attachment A <br />TEXT OF FLORIDA STATUTES, SECTION 338.071 <br />338.071 Safety Inspection of Bridges <br />(1) For the purposes of this section, the word "bridge" means a <br />publicly owned structure, including supports erected over a depression <br />or an obstruction such as water or a highway or railway, having a track <br />or passageway for carrying traffic or other moving loads and having an <br />opening measured along the center of the roadway of more than 20 feet <br />between undercopings of abutments or spring lines of arches or extreme <br />ends of openings for multiple boxes; it may include multiple pipes where <br />the clear distance between openings is less than half of the smaller <br />contiguous opening. <br />(2) Prior to October 1, 1977, and at regular intervals thereafter <br />not to exceed 2 years, each bridge on a public highway, road, or street <br />shall be inspected as to the structural soundness and ,safety thereof for <br />the passage of traffic thereon. The thoroughness with which bridges are <br />to be inspected shall depend on such factors as age, traffic character- <br />istics, state of maintenance, and known deficiencies. The jurisdictional <br />authority or owner shall be responsible for having inspections performed <br />and reports prepared in accordance with the provisions contained herein. <br />(3a) Each structure defined as a bridge under subsection (1) and <br />being used by the public is required to be inspected by a qualified <br />bridge inspector as defined herein as to its safe load -carrying capacity <br />and traffic safety. <br />(3b) All inspections are to be reported on a format designated by <br />the Department of Transportation and forwarded to the department at <br />intervals pursuant to subsection (2). Data on newly completed structures, <br />or any modification of existing structures which would alter previously <br />recorded data on the inspection reports shall be submitted to the <br />department within 90 days by the jurisdictional authority or owner. <br />(3c) The Department of Transportation shall maintain inspection <br />reports and an inventory of bridges reported pursuant to this section. <br />(4a) Individuals inspecting bridges and completing reports <br />required by this section shall possess the following minimum <br />qualifications: <br />1. Be a registered professional engineer; or <br />2. Have a minimum of 5 years' experience in bridge inspec- <br />tion assignments in a responsible capacity and have <br />completed a comprehensive training course approved by the <br />department. <br />(4b) Individuals executing reports required by this section shall <br />be registered professional engineers. <br />(5) Within 6 months following the respective dates specified in <br />subsection (2), the department shall prepare a report of its findings <br />with respect to each such bridge or other structure whereon significant <br />structural deficiencies were discovered and file such report with the <br />Governor and the presiding officer of each house of the Legislature.
