HE <br />ASKED IF WE CAN CONSIDER CHANGING DIFFERENT PORTIONS AS LONG AS WE <br />DOWNGRADE THE ZONING. <br />ATTORNEY COLLINS STATED HE PERSONALLY WOULD PREFER TO SEE <br />IT READVERTISED, BUT FELT IT IS A LESSER USE AND WITH A STIPULATION <br />FROM THE APPLICANT, HE BELIEVED THE BOARD COULD MOVE AHEAD. <br />MOTION WAS MADE BY COMMISSIONER WODTKE TO ADOPT ORDINANCE <br />80-9 AUTHORIZING A CHANGE IN ZONING TO C -IA FOR THE 150 X 250 PIECE <br />IN THE NORTHWEST SECTION OF THE SUBJECT PARCEL; THE REMAINDER TO <br />STAY IN R-3. <br />MOTION DIED FOR LACK OF A SECOND. <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY COMMIS- <br />SIONER DEESON, TO DENY THE REZONING REQUEST ON THE BASIS THAT THERE <br />ALREADY IS SUFFICIENT B-1 ZONING IN THE AREA AND BECAUSE IT WOULD <br />BE, IN EFFECT, SPOT ZONING. <br />COMMISSIONER WODTKE COMMENTED THAT HERE WE HAVE A SINGLE <br />PROPERTY OWNER WHO HAS TEN ACRES, AND ALTHOUGH THIS INTERSECTION DOES <br />NOT YET BEAR THE SAME TRAFFIC AS 510 AND 512, HE FELT THERE IS A <br />NEED AND THAT YOU SHOULD NOT HAVE THE COMMERCIAL ZONING ON ONE SIDE <br />OF THE ROAD AND DENY IT ON THE OTHER SIDE. HE BELIEVED BY ZONING <br />THIS IN A WAY THAT CREATES A BUFFER, WE CAN PROPERLY CONTROL THAT <br />AREA. COMMISSIONER WODTKE DID NOT SEE ANY PARTICULAR NEED FOR THE <br />APPLICANT TO GO TO THE B-1, AND FELT IF THERE IS SUCH A NEED IN THE <br />FUTURE, IT COULD BE ADDRESSED AT THAT TIME. HE FURTHER FELT THAT WITH <br />TODAY IS ECONOMY, THERE IS A NEED FOR CONVENIENCE STORES SINCE THEIR <br />SELF-SERVICE GAS PUMPS ARE ABOUT THE LEAST EXPENSIVE BECAUSE THEY <br />CAN TAKE THE PROFITS IN THE STORE AND NOT SO MUCH ON THE GAS. <br />CHAIRMAN SIEBERT WAS OF THE OPINION THAT GAS IS MORE <br />EXPENSIVE IN CONVENIENCE STORES AND STATED THAT HE FELT DIFFERENTLY <br />FROM -EVERYONE BECAUSE WHILE HE AGREED THERE MAY BE A NEED FOR A <br />CONVENIENCE STORE, HE DID NOT FEEL A GAS STATION WAS NEEDED, AND HE <br />DID NOT FEEL YOU WOULD WANT B-1 ON THAT INTERSECTION. <br />
