<br />Capitol Projects Manager Mike Hotchkiss reviewed the memorandum, stating that <br />staff is now ready to begin the assessment process associated with this project and requested the <br />Board approve the Resolution. <br /> <br />The Chairman opened the public hearing. There were no speakers and the <br />Chairman closed the public hearing. <br /> <br />ON MOTION by Commissioner Wheeler, SECONDED <br />by Commissioner Bowden, the Board unanimously <br />approved Resolution 2005-112, confirming the special <br />assessment in connection with water main expansion to <br />thth <br />Carll Heights Subdivision (6 Place West of 27 <br />Avenue), and providing for special assessment liens to be <br />made of record. <br /> <br />9.B.1. PUBLIC DISCUSSION - ALFRED C. BALDWIN - REQUEST <br />TO SPEAK REGARDING SWALE ISSUE AT LINDSEY LANES <br />th <br />Alfred C. Baldwin <br />, 4740 47 Court, brought photographs of his development to <br />display the standing water and serious health problem caused by the daily sprinkler system <br />flooding in the swale at Lindsey Lanes. Apparently the homeowners have not been able to get <br />anyone to take on the responsibility of solving the problem and he asked the Board to take action. <br />This problem has been going on for three or four years. <br />County Attorney Collins stated it needs to be determined if this is the <br />responsibility of the County. He advised if it is a public dedicated drainage easement, which is <br />rare, then the County would be responsible. <br />Mr. Baldwin <br /> was positive that the property is in the right-of-way. <br />Discussion ensued regarding the difference between Phases I, II and III. <br />July 12, 2005 21 <br /> <br />
