APP 91980 <br />900K 43 w 2l <br />CHAIRMAN SIEBERT ASKED ATTORNEY SULLIVAN JUST WHAT PURPOSE <br />THERE WAS IN CHANGING THIS ZONING TO AGRICULTURAL IF MR. MACKENZIE'S <br />INTENDED USES ARE EXACTLY AS STATED, AND ATTORNEY SULLIVAN BELIEVED <br />THE MAJOR REASON IS A TAX REASON BECAUSE THE AGRICULTURAL ZONING <br />WOULD RESULT IN LOWER TAXES ON THE PROPERTY. <br />THE CHAIRMAN NOTED THAT AGRICULTURAL ZONING DOES NOT <br />NECESSARILY MEAN A LOWER ASSESSMENT, AND MR. SULLIVAN COMMENTED THAT <br />MR. MACKENZIE CAN PUT IN A GROVE AND GET THE AGRICULTURAL EXEMPTION. <br />COMMISSIONER Loy POINTED OUT THAT IF IT IS A BONA FIDE <br />AGRICULTURAL'OPERATION, YOU CAN GET THE EXEMPTION REGARDLESS OF THE <br />ZONING. <br />ATTORNEY COLLINS COMMENTED THAT THE AD VALOREM TAX LAW HAS <br />CHANGED LATELY, AND IT IS THE USE OF THE PROPERTY THAT IS OVERRIDING, <br />NOT THE ZONING. HE FELT IF MR. MACKENZIE DID PLANT CITRUS, HE <br />PROBABLY WOULD QUALIFY FOR AGRICULTURAL EXEMPTION, BUT WITH BARE <br />LAND, HE WOULD NOT, REGARDLESS OF THE ZONING. <br />KENNETH MACKENZIE INFORMED THE BOARD THAT HE WOULD LIKE <br />HIS PARCEL TO BE ZONED BACK TO AGRICULTURAL, AND HE HAD THOUGHT IT <br />WOULD BE A TAX SAVING FOR HIM. HE STATED THAT HE DOES NOT WISH TO <br />SUBDIVIDE, BUT JUST WISHED TO BUILD HIS OWN HOME AND PUT THE TREES <br />BACK, WHETHER CITRUS OR OAK. HE POINTED OUT THAT THE REST OF THE <br />80 ACRE TRACT, WHICH IS COMPLETELY SURROUNDED BY AGRICULTURAL, IS <br />GOING TO BE SUBDIVIDED INTO ONE ACRE HOME SITES, AND HE FELT THIS <br />IS A TOTAL PIECE OF SPOT ZONING DONE BY THE BOARD LESS THAN A YEAR <br />AGO. HE CONTINUED THAT HE WAS TOLD THAT TO PUT IN A BREEDING KENNEL, <br />HE WOULD HAVE TO BE IN AN AGRICULTURAL AREA. MR. MACKENZIE STATED <br />THAT HE ONLY WISHED TO BREED VERY EXPENSIVE DOGS, AND R -IE ONLY <br />ALLOWS FIVE DOGS FOR BREEDING. HE STATED THAT HE WOULD NOT HAVE <br />ATTACK DOGS AND FELT THERE ARE DOGS PRESENTLY LOOSE IN THE NEIGHBOR- <br />HOOD MORE DANGEROUS THAN ANY HE WOULD BREED, <br />CHAIRMAN SIEBERT COMMENTED THAT THE BOARD HAD BEEN INFORMED <br />THAT MR. MACKENZIE DID NOT INTEND TO PUT IN A KENNEL. <br />
