JENNINGS, Administrator 2145 14th Avenue Vero Beach, Florida 32960 <br />April 25, 1980 <br />Mr. Robert Moresi, Director <br />Department of Resource Management <br />St. Johns River Water Management District <br />Post Office Box 1429 <br />Palatka, Florida 32077 <br />SUBJECT: REQUEST FOR WAIVER OF DISTRICT PROCEDURES <br />Dear Mr. Moresi: <br />Indian River County is embarking on a water -supply development program in the <br />south county area. One of the points of discussion between consultants repre- <br />senting Indian River County and you and other staff members of the St. Johns <br />River Water Management District has been the procedural steps to be taken by <br />Indian River County in filing for well construction permits and a water -use <br />permit. <br />The County has decided to proceed with the release of specifications and bid <br />documents for the construction of two production wells and one monitor well. <br />Enclosed are two applications for public water supply well construction per- <br />mits and one application for water -use permit. The production and observation <br />wells will be installed to provide technical data that will allow the County's <br />consultants to complete the design of the water system. <br />Indian River County is asking the Governing Board to waive several "Rules of the <br />St. Johns River Water Management: Regulation of Wells" so that the County may <br />proceed with the compilation and interpretation of technical data by constructing <br />and testing wells. <br />The requests are being made by Indian River County with consideration of the <br />following facts. A testing program utilizing production wells is very expensive <br />but not very much more expensive than a testing program utilizing test wells. <br />The County feels that wells designed for this program must be acceptable to the <br />District and to the D.E.R. if competitive selection among the various bidders is <br />to be made and negotiations are to be completed. The policy of the Farmers Home <br />Administration, which will be providing grant -and -loan funding for this program, <br />requires that all permits for construction must be approved before a construction <br />contract can be signed. Therefore, the following waivers of District rules are <br />requested: <br />1. Waive Chapter 40C-3.05 and approve water -well construction permit applica- <br />tions for production wells without prior issuance of a water -use permit. <br />2. Waive Chaper 40C -3.10(f) and approve the above applications with the proviso <br />that final authorization to commence construction will be made by the District <br />after the submission of the name, address, license number and signature of the <br />selected drilling contractor. <br />4 <br />All wells will be constructed in accordance with the laws of the State of Florida <br />and Indian River County. The County is well aware that the production wells may <br />be of a much greater design capacity than will be permitted for use by the District. <br />Indian River County requests the Governing Board's immediate consideration of these <br />requests so that project scheduling and funding may be finalized in the near future. <br />Sincerely, <br />Jack G.
