THE COUNTY ACCEPTS THE SYSTEM NOW OR LATER. HE CONTINUED THAT IF <br />WE ARE TO DEFER ACCEPTING THE PLANTS, HE FELT WE NEED TO HAVE SOME <br />KIND OF A CONTRACT SPECIFICALLY OUTLINING THE PROCEDURES TO BE <br />FOLLOWED, AND HE WOULD RECOMMEND THAT THE COUNTY TRY AND ASSIMILATE <br />THE PLANT AS SOON AS POSSIBLE, HIS REASONS BEING NOT SO MUCH LEGAL <br />AS THAT THE PARTIES ALL KNOW ONE ANOTHER NOW AND THE RELATIONSHIPS <br />ARE GOOD AND WE DON T KNOW WHAT THEY WILL BE IN TWO YEARS. HE <br />STATED THAT HE WAS NOT SUGGESTING THAT THE COUNTY CONTROL THE UTILITY <br />PLANTS TO THE EXTENT THAT THEY WOULD HAMPER THE DEVELOPMENT OF VISTA <br />ROYALE. <br />ENGINEER RALPH ENG NOTED THAT NORMALLY FMHA WOULD REQUIRE <br />YOU TO HAVE THESE SYSTEMS IN HAND LEGALLY BEFORE YOU CONTRACT FOR <br />CONSTRUCTION, BUT HE HAS EXPLAINED THE SITUATION TO THEM, AND THEY <br />HAVE STATED THAT A LEGAL DOCUMENT IN THE FORM OF AN AGREEMENT BETWEEN <br />THE COUNTY AND THE FRANCHISE OWNER STATING THAT WHEN CONSTRUCTION IS <br />A CERTAIN PERCENT COMPLETED THEY WILL TIE IN, IS ACCEPTABLE. <br />CHAIRMAN SIEBERT ASKED IF THERE WOULD BE ANY ADVANTAGE TO <br />TAKING OVER THE SYSTEM NOW AND HAVING A MANAGEMENT CONTRACT, AND <br />ATTORNEY COLLINS FELT THERE.WOULD BE. <br />COMMISSIONER LYONS ASKED IF THAT WOULD MEAN, WE WOULD, IN <br />EFFECT, OPERATE THE VISTA ROYALE SEWER AND WATER SYSTEM, AND <br />ATTORNEY COLLINS STATED THAT IF THE COUNTY TOOK IT OVER, WE WOULD <br />BE RESPONSIBLE, BUT COULD PROBABLY HAVE A MANAGEMENT CONTRACT WITH <br />THE VISTA PEOPLE SO THEY WOULD BE DOING MOST OF'IT. <br />COMMISSIONER LYONS STATED THAT HE CERTAINLY HAD NO INTENTION <br />OF DOING ANYTHING TO CREATE A PROBLEM FOR THE VISTA PEOPLE IN CON- <br />TINUING THEIR PROJECT ACTIVITIES, BUT HE WAS INCLINED TO AGREE THAT <br />4 <br />WE SHOULD PROCEED TO ACQUIRE THE PLANTS WHILE WE ALL UNDERSTAND <br />WHAT WE ARE GOING TO DO AND HAVE GOOD RELATIONSHIPS. <br />MR. GASKILL INFORMED THE BOARD THAT THIS HAD BEEN MENTIONED <br />TO HIM, AND WHILE THEY WOULD JUST AS SOON KEEP CONTROL UNTIL THINGS <br />ARE BUILT, THEY WOULD BE AGREEABLE IF THEY HAD A MANAGEMENT AGREEMENT <br />PRIOR TO START UP OF THE COUNTY SYSTEM. <br />APR 2 3 1980 <br />121 <br />BOOK. , 4j FA'E`75 <br />
