summarized the concerns of the 66th Avenue property owners (with whom staff had met), as <br />follows: <br />Timing of the "Notice -to -Owner" Letter (which includes notification of the <br />County's interest in their property as well as the notification of statutory rights) <br />Slow pace of County condemnation of properties along 66th Avenue <br />Director Mora then presented staff's recommendation to amend the Resolution, <br />such that the "Notice to Owner" letter is sent out earlier, so that the property owners will be <br />advised of their statutory rights prior to negotiations with County staff. <br />Assistant County Administrator Michael Zito added to the PowerPoint <br />presentation, detailed voluntary and involuntary acquisitions, which comprise the three phases of <br />right-of-way acquisition. He provided legal definitions of Eminent Domain, and used case law <br />to illustrate the requirements for pre -suit negotiations. He conveyed staff's belief that Eminent <br />Domain should be the last step in any negotiation process; discussed the proposed revisions to <br />Resolution 2007-027; and reiterated that the amended Resolution would <br />provide for notice to be sent to property owners prior to any written offer. Mr. Zito thereafter <br />asked the Board to approve staff's recommendation, amending County policies for acquisition of <br />right-of-way for road expansion and improvement projects previously set forth in Resolution <br />2007-027. <br />Commissioner O'Bryan, referred to Section 4 of the proposed Resolution, <br />where it states that the Consulting Engineer would be directed to prepare the SCALE* Report <br />following 60% design completion, and asked if that wasn't a bit late in the process.
