AGREEMENT <br />THIS AGREEMENT, entered into the 25th day of <br />June , 1980, by and between INDIAN RIVER COUNTY <br />POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, hereinafter <br />referred to as "County" and FLORIDA INSTITUTE OF TECHNOLOC,Y,INC., <br />a not for profit educational institution authorized to do <br />business in the State of Florida, hereinafter referred to <br />as "F.I.T.", their successors and assigns. <br />WHEREAS, both County and F.I.T. have applied to <br />the appropriate governmental branches for distribution by the <br />General Services Administration of that property located in <br />Indian River County, commonly known as the "Tracking Station" <br />and more particularly described in attached Exhibit "A" to <br />this Agreement, which is incorporated herein, and <br />WHEREAS, both County and F.I.T. have received notifi- <br />cation from the General Services Administration requesting a <br />compromise by the parties as to division of the property, and <br />WHEREAS, both County and F.I.T. have been advised by <br />the General Services Administration that they are the only <br />applicants qualified to receive distribution of the property <br />described in Exhibit "A", and <br />WHEREAS, County has an acknowledged long-standing <br />interest in developing a public ocean front park on the track- <br />ing station property, and <br />WHEREAS, F.I.T., through an oceanographic research <br />center located in Indian River County, could expand the range <br />of programs available to college level and be a benefit to <br />Indian River County, <br />NOW, THEREFORE, in consideration of the mutual <br />promises and to resolve the conflict between the parties, it <br />is agreed: <br />JUN 2 51980 <br />sooA 43, FACE8 <br />
