What the County has allowed to be <br />built on an easement is a fence and the owner would have to agree to remove it should access to the <br />easement be required. He could not speak as to why such an overhang had been allowed in the <br />past. <br />A lengthy discussion ensued with participation by Mr. Sanders, various <br />Commissioners, Community Development Director Bob Keating, County Administrator Baird, <br />and Public Works Director Jim Davis. Several suggestions were offered but were not acceptable <br />by one or the other party. There was also discussion as to this having been done in the past but it <br />was not known how many times nor how many other lot owners might encounter this same <br />problem. <br />County Attorney Collins declared that the issue came down to whether the County <br />wished to release 2’ of its easement. <br />Commissioner Davis thought County Attorney Collins’ advice was probably in Mr. <br />Sander’s best interest. <br />Director Davis had seen a copy of the house plans and in his opinion the house could <br />be reduced by 2’. He was concerned about the use of a bucket truck in that space. <br />Director Keating described the process for a release of easement and suggested it <br />could be expedited if Mr. Sanders “walked it through”. <br /> <br />MOTION WAS MADE by Commissioner Neuberger, <br />SECONDED by Commissioner Davis, to release the <br />necessary 2’ easement to allow Mr. Sanders to build his <br />home as designed. <br /> <br />Mr. Sanders <br /> inquired what would happen if a franchise holder did not agree, to <br />which County Attorney Collins responded that he could then bring it to the Board. <br /> <br />September 13, 2005 34 <br /> <br />
