The Board approved: (1) to have <br />Imagine Schools post the $350,000 bond for the <br />construction of the left turn lane on 4th Street and to not <br />permit left turns into the school until the left turn lane is <br />constructed; (2) to have an officer on-site to control <br />traffic; and (3) to have the Sheriff's Department impose <br />traffic citations on Imagine Schools should traffic stacking <br />occur on 4th Street. <br />The Chairman called a recess at 1:18 p.m. and reconvened the meeting at 2:01 <br />p.m., with all members present. <br />Clerk's Note: The following discussion occurred following Item 14.B.1., and is <br />placed here for continuity. <br />Commissioner Wheeler sought clarification as to who would be responsible for <br />purchasing the right-of-way for the left turn lane when it is needed; and who would be <br />responsible to culvert the ditch. <br />Vice Chairman Davis responded that it would be the County's responsibility to <br />purchase the necessary right-of-way for the left turn lane. <br />Commissioner Wheeler wanted it on record that this might be setting a precedent, <br />as he was unsure of whether there had ever been a private development which needed right-of- <br />way to put in a turning lane, where someone else had to purchase the property. He sought and <br />received confirmation from Attorney Collins that because the right-of-way was across the street <br />from Imagine Schools, which does not own the property, the County would have to purchase the <br />property and culvert the ditch. Attorney Collins added that if the left turn lane is needed, the <br />$350,000 which Imagine Schools is posting would be applied towards all of those costs. <br />27 <br />September 16, 2008 <br />
