JUL 30199® <br />Box .44 FAcE 1C7p <br />REQUEST FROM STATE ASSOCIATION OF COUNTY COMMISSIONERS FOR PHOTO <br />OF COURTHOUSE <br />IN DISCUSSION, IT WAS FELT THAT WITH THE NEW LANDSCAPING <br />THAT HAS BEEN DONE, A NEW PHOTOGRAPH SHOULD BE TAKEN OF THE COURTHOUSE. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />LOY, THE BOARD AUTHORIZED THE ADMINISTRATOR TO OBTAIN A PHOTO OF THE <br />COURTHOUSE. <br />DISCUSSION OF -REQUEST FOR RELEASE OF BOND ON MITCHELL SUBDIVISION - <br />WITHDRAWN FROM AGENDA <br />ADMINISTRATOR JENNINGS INFORMED THE BOARD THAT HE HAD RECEIVED <br />A REQUEST FOR RELEASE OF BOND ON MITCHELL SUBDIVISION IN THE AMOUNT <br />OF $25,000. THERE STILL WOULD BE $5,000 RETAINED FOR SODDING, <br />DRESSING, ETC. <br />COMMISSIONER WODTKE COMMENTED THAT HE HAD UNDERSTOOD THAT <br />WE WERENIT GOING TO GO ALONG WITH RELEASING BONDS PARTIALLY, AND <br />CHAIRMAN SIEBERT DID NOT BELIEVE THIS IS AN EMERGENCY ITEM. HE ASKED <br />IF THE ADMINISTRATOR WERE RECOMMENDING THE RELEASE. <br />ADMINISTRATOR JENNINGS STATED THAT HE WOULD ONLY RECOMMEND <br />IT SUBJECT TO THE FINAL APPROVAL OF THE ATTORNEY. <br />ATTORNEY COLLINS SUGGESTED THAT THE BOARD HOLD OFF ON THIS <br />SINCE THE APPLICATION WASNIT FILED IN TIME TO BE ON THE REGULAR <br />AGENDA. HE FELT THIS WOULD BE MORE APPROPRIATE THAN CITING LEGAL <br />REASONS; ALTHOUGH, HE NOTED,THERE ARE SOME LEGAL MATTERS THAT NEED <br />TO BE STRAIGHTENED OUT — THE LINES WERE TO BE DEEDED BACK AND THIS <br />HAS NOT BEEN DONE AS YET. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />Loy, THE BOARD UNANIMOUSLY INSTRUCTED THAT THE ITEM IN REGARD TO <br />RELEASE OF THE BOND ON MITCHELL SUBDIVISION BE REMOVED FROM THE AGENDA <br />BECAUSE IT DID NOT MEET THE PROCEDURAL REQUIREMENTS. <br />COMMISSIONER Loy COMMENTED THAT IT APPEARS THAT THE DEVELOPER <br />OF MITCHELL SUBDIVISION HAS LOCATED THEIR WATER PLANT SO THAT THERE <br />
