MARSH POINTED OUT THAT THERE IS AN ADDITIONAL 10' <br />EASEMENT, AND THEY WILL PUSH TO GET, ADEQUATE DRAINAGE. <br />ATTORNEY COLLINS NOTED THAT THE ROAD IS A DEDICATED ROAD <br />AND WONDERED WHY THE ADJACENT EASEMENT IS PRIVATE. <br />ADMINISTRATOR JENNINGS COMMENTED THAT THE ONLY RIGHT-OF-WAY <br />THE COUNTY HAS IS WHAT THEY TOOK BY MAINTENANCE SOMETIME AGO. IT IS <br />A VERY RESTRICTED ROAD, AND IT WILL BE A VERY DIFFICULT ROAD TO MAIN- <br />TAIN BECAUSE OF THE PROBLEM WITH THE TREES AND ROOTS. HE ASKED IF <br />THE ATTORNEY WAS TALKING ABOUT THE ROAD RIGHT-OF-WAY, AND THE <br />ATTORNEY EXPLAINED THAT HE MEANT THE ADJACENT EASEMENT. <br />MR. MARSH NOTED THAT THIS WAS REQUESTED IN THE TECHNICAL <br />REVIEW COMMITTEE, AND THE ADMINISTRATOR HAD STATED THAT HE DID NOT <br />WANT TO HAVE THE COUNTY HAVE TO MAINTAIN ALL THAT. <br />ATTORNEY COLLINS DISCUSSED THE TREES FALLING OVER THE ROAD, <br />AND STATED HE WOULD LIKE TO ELIMINATE THE TREES FROM COUNTY OWNERSHIP, <br />IF POSSIBLE. <br />COMMISSIONER LYONS STATED THAT HE COULD UNDERSTAND THE <br />INTERNAL EASEMENTS BEING PRIVATE, BUT FELT WE MAY BE HEADING FOR <br />TROUBLE IN THE LONG RUN IF THE EASEMENT ALONG THE ROAD BECOMES A <br />PRIVATE EASEMENT, <br />ADMINISTRATOR JENNINGS STATED THAT HE WOULD GO ALONG WITH <br />TAKING THE NORTH -SOUTH EASEMENT AS THERE IS NO REASON FOR IT TO BE <br />PRIVATE, BUT BELIEVED WE SHOULD LEAVE OUT THE EAST -WEST EASEMENTS AS <br />THE COUNTY DOES NOT WANT TO HAVE TO KEEP THOSE DITCHES OPEN. <br />CHAIRMAN SIEBERT FELT THE CLEANEST WAY TO DO THIS IS TO <br />ABANDON THIS PLAT AND START ALL OVER UNDER TODAY IS REGULATIONS. <br />ADMINISTRATOR JENNINGS STATED THAT HIS UNDERSTANDING IS IF <br />YOU FILE A REPLAT OF A PLAT, THE REPLAT THEN BECOMES THE PLAT, HE <br />NOTED THAT THIS IS NOT THE PLAT THAT WILL GO ON RECORD. <br />CHAIRMAN SIEBERT STATED THAT THIS PLAT DOES NOT COVER IT ALL. <br />ATTORNEY COLLINS EXPLAINED THAT THEY ARE ANTICIPATING RE - <br />PLATTING THE EXISTING PLAT.
