HE ADDED THAT IS WHY IT IS IMPORTANT THAT WE <br />TALK IN TERMS OF It AND/OR." <br />ATTORNEY .JOHNSTON STATED HE HAD NO OBJECTION TO THAT, THE <br />ONLY THING HE WOULD SUGGEST WAS RATHER THAN RELEASING ALL OF THE <br />FUNDS, JUST RELEASE HALF OF THE FUNDS. <br />ATTORNEY COLLINS FELT THIS WAS NO PROBLEM. <br />DISCUSSION CONTINUED ABOUT THE IMPACT FEES. <br />UTILITIES DIRECTOR LINER EXPLAINED THAT IT WOULD BE $295 <br />FOR WATER AND $295 FOR SEWER ON A RESIDENTIAL UNIT, AND $1,716 IS WHAT <br />WAS SET UP FOR THE COMMERCIAL UNIT, BASED ON 41 UNITS. <br />ATTORNEY JOHNSTON FELT THAT THE COUNTY WAS NOW DOUBLING THE <br />FIGURE FIRST DISCUSSED AND FELT IT WAS PROHIBITIVE. <br />ATTORNEY COLLINS EXPLAINED THAT THE ORDINANCE ESTABLISHES <br />ALL THE FIGURES THEY ARE USING - ALL THE COUNTY IS TRYING TO DO IS <br />ACCUMULATE THE FEES SO THAT THE FUNDS ARE AVAILABLE WHEN THE HOOK UP <br />DOES OCCUR. <br />COMMISSIONER LYONS ASKED I:F THEY WERE DEFENDING THE ORDINANCE <br />OR THE CONTRACT, AND WENT ON TO QUOTE THE RESIDENTIAL AND COMMERCIAL <br />FEES FOR WATER AND SEWER. <br />UTILITIES DIRECTOR LINER ADVISED THEY REFERRED TO ORDINANCE <br />80-21, AND THE FEE DEPENDS ON THE SIZE OF THE UNITS. <br />DISCUSSION FOLLOWED ABOUT THE MISUNDERSTANDING BETWEEN THE <br />PARTIES, AND IT WAS DETERMINED THIS WAS A COMMUNICATIONS PROBLEM. <br />ATTORNEY COLLINS FELT THE FRANCHISE COULD BE APPROVED SUBJECT <br />TO THE CHANGES ON PAGE 12. <br />CHAIRMAN SIEBERT ASKED IF THERE WAS ANYONE PRESENT WHO WISHED <br />TO BE HEARD. <br />WILLIAM KOOLAGE, 815 26TH AVENUE, APPROACHED THE BOARD AND <br />SUGGESTED THE BOARD RECESS THE PUBLIC HEARING UNTIL THE INFORMATION <br />THAT IS NEEDED IS PRODUCED. <br />COMMISSIONER LOY ASKED WHAT THE DEVELOPER WAS PLANNING AS <br />FAR AS RESIDENTIAL UNITS, AND THE DEVELOPER DID NOT KNOW EXACTLY. <br />
