REGARDING THE 600,000 GALLON 6TH AVENUE ALLOCATION, <br />WHEN THAT IS REALLOCATED TO THE SOUTH BEACH, THEY WANT THE OPPORTUNITY <br />TO HAVE ANY EXCESS THAT MAY BE AVAILABLE ALLOCATED SOMEPLACE ELSE BY <br />MUTUAL CONSENT. LASTLY, THEY REQUESTED AN ARBITRATION PARAGRAPH BE <br />ADDED. THE ATTORNEY CONTINUED THAT THERE ARE A NUMBER OF MINOR WORD <br />CHANGES, NONE OF WHICH HAVE ANY SUBSTANTIAL AFFECT ON THE INTENT OF <br />THE AGREEMENT. HE STATED THAT AFTER RESOLVING VARIOUS PROBLEMS, THE <br />CITY DID APPROVE THE AGREEMENT, AND HE WOULD REQUEST THAT IF THE BOARD <br />IS SATISFIED WITH THE CHANGES, THAT THEY RECOMMEND ITS APPROVAL. <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY COMMIS- <br />SIONER Loy, THAT THE CHAIRMAN BE AUTHORIZED TO SIGN THE AGREEMENT <br />BETWEEN THE CITY OF VERO BEACH AND THE COUNTY IN REGARD TO SOUTH <br />BEACH WATER, WITH THE CHANGES NOTED BY THE ATTORNEY. <br />CHAIRMAN SIEBERT COMMENTED THAT THEY CONSISTENTLY REFER TO <br />A 24" LINE. HE QUESTIONED THE FORMULA FOR DETERMINING THE SIZING OF <br />THE LINE BECAUSE HE FELT THAT MAXIMUM BUILD -OUT NEVER WILL BE ACHIEVED <br />BECAUSE OF THE SUBDIVISIONS OF RECORD, HE CONTINUED THAT THERE ARE <br />SOME OBJECTIONS FROM THE DEVELOPERS ABOUT FRONTING MONEY FOR SOMETHING <br />THAT MAY NOT BE NECESSARY. <br />COMMISSIONER LYONS EXPLAINED THAT THIS IS A TAPERED LINE; <br />IT COULD BE LESS THAN 24" OR COULD BE 24" FOR ONLY A SHORT DISTANCE. <br />THEY, THEREFORE, CALLED IT 24" IN ORDER NOT TO MISLEAD PEOPLE INTO <br />THINKING THAT 20" WAS THE ABSOLUTE MAXIMUM. <br />ENGINEER JOHN ROBBINS AGREED THAT THE LINE NEEDS TO BE <br />SIZED BY HYDRAULICS AND EXACT NEEDS. <br />CHAIRMAN SIEBERT STATED THAT HIS POINT IS THAT WHEN WE <br />ACTUALLY ENGINEER THE LINE, WE WANT TO BE SURE THE FIGURES ARE <br />REALISTIC AND THAT WE ARE NOT OVERENGINEERING AND ADDING SUBSTANTIAL <br />COSTS FOR THE DEVELOPERS TO BEAR. HE REPEATED THAT EVEN THOUGH THE <br />LAND USE PERMITS A HIGHER DENSITY, HE DID NOT BELIEVE IT CAN BECOME <br />A REALITY. <br />a <br />
