SEP 2 41960 BOOK, 44 PACE 668 <br />UTILITY DIRECTOR LINER NOTED THAT ANOTHER MAJOR FACTOR <br />IS THAT THERE SHOULD BE NO COMPLAINT FROM THE NEIGHBORS SINCE <br />THEY ARE THE ONES SELLING US THIS PROPERTY FOR THIS PURPOSE. <br />COMMISSIONER LYONS STATED THAT HE DID WANT TO SEE THIS <br />PUBLICIZED AND A PUBLIC HEARING HELD, IF NECESSARY. HE ASKED IF <br />THEY WERE SURE THE EXCESS DIRT WOULD NOT BE NEEDED TO BUILD UP <br />THE POND WALLS AS HIGH AS POSSIBLE TO AVOID ANY FLOOD CONDITIONS. <br />ENGINEER ROBBINS EXPLAINED THAT THERE WOULD BE A 3' BERM <br />ABOVE THE NATURAL GRADE. THIS PROPERTY IS ON THE RIDGE; HE DOUBTED <br />THERE WOULD BE ANY FLOODING; AND THIS WOULD BE EXCESS MATERIAL <br />AFTER CONSTRUCTING THE BERM. <br />CHAIRMAN SIEBERT ASKED IF WE SHOULD SCHEDULE A PUBLIC <br />HEARING AND MAKE THE OFFER PENDING THE OUTCOME OF THE PUBLIC HEARING. <br />ATTORNEY COLLINS STATED THAT THIS IS DISCRETIONARY WITH <br />THE BOARD. HE NOTED THAT WE MUST KEEP IN MIND THAT THE DER IS <br />HOLDING US TO THE ORIGINAL SCHEDULE, AND WE HAVE TO BE DONE BY <br />FEBRUARY, <br />COMMISSIONER LYONS STATED THAT HE WOULD LIKE TO SEE BOTH <br />THINGS GO FORWARD AND ASKED IF IT WOULD BE POSSIBLE TO NEGOTIATE <br />THIS WITH THE UNDERSTANDING THAT FINALIZATION IS DEPENDENT ON THE <br />OUTCOME OF THE PUBLIC HEARING. ATTORNEY COLLINS AGREED THAT COULD <br />BE DONE, AND CHAIRMAN SIEBERT SUGGESTED THAT THE HEARING BE SCHEDULED <br />FOR THE NEXT REGULAR MEETING. <br />COMMISSIONER WODTKE ASKED IF WE CAN USE SOME OF THE MONEY <br />WE HAVE LEFT FROM FMHA TO PURCHASE THIS LAND, AND ENGINEER ROBBINS <br />STATED THAT COULD BE DONE. <br />COMMISSIONER WODTKE EXPRESSED CONCERN ABOUT US SAYING WE <br />WERE GOING TO TAKE CARE OF THE WATER TAP -INS AND THE SEWER TAP -INS <br />AND THE ASSOCIATED COSTS. HE ASKED IF IT WOULD BE BETTER TO PAY <br />MR. HARDEE MORE MONEY IN CASH AND THEN HAVE HIM PAY THESE FEES SO <br />THOSE DOLLARS WOULD COME BACK INTO THE ENTERPRISE ACCOUNT. <br />ATTORNEY COLLINS STATED THEY HAD DISCUSSED THAT FEATURE, <br />AND IT WAS THE CONSENSUS OF STAFF THAT WE WERE BETTER OFF CONTROL- <br />LING THAT SITUATION WHERE WE COULD KEEP TO OUR OWN TIMEFRAME. HE <br />ALSO DOUBTED THAT MR. HARDEE WOULD AGREE SINCE HE ALREADY IS CON- <br />CERNED ABOUT THE RATES HE WILL PAY. <br />
