SEP 2 41960 <br />:aaox 44 PAGE 604 <br />CHAIRMAN SIEBERT NOTED THAT THERE ARE MANY STEPS THAT THE <br />DEVELOPERS WILL HAVE TO GO THROUGH, AS THEY CANNOT DO ANY CONSTRUCTION <br />WITHOUT WATER BEING THERE. <br />DISCUSSION FOLLOWED AND IT WAS DETERMINED THAT MR. CAIN, <br />WHO OWNS PROPERTY NORTH OF WABASSO ROAD, WAS PART OF THE LEWIS TRUSTEE, <br />ALONG WITH MR. SCHAUB. <br />RICK SCHAUB INFORMED THE BOARD THAT MR. CAIN WAS HIS UNCLE. <br />MR, RYDER FELT THESE RELATIONSHIPS AND THE PROPERTY INVOLVED <br />WOULD CAUSE A DOMINO EFFECT. <br />LOMAX GWATHMEY, 23 SEA HORSE LANE, APPROACHED THE BOARD AND <br />NOTED THAT THE REQUEST IS TO GET A DEFINITION OF THE TYPE OF BUILDING <br />THE OWNER CAN BUILD - HE DOES NOT NEED A DENSITY OF S TO EXECUTE <br />HIS PROJECT, BUT HE CANNOT BUILD CLUSTER HOUSING UNDER THE PRESENT <br />DEFINITION. HE SUGGESTED THAT IT WOULD BE EASIER FOR ALL CONCERNED <br />TO GO BACK TO THE DRAWING BOARD. <br />ATTORNEY HENDERSON WAS OPPOSED TO HAVING A MORATORIUM AT <br />THIS TIME. HE STATED THAT THERE IS A DEEP WATER .AQUIFER WHICH SHOWS <br />A 35' LEVEL, MEANING THE PRESSURE THERE IS ADEQUATE. ATTORNEY <br />HENDERSON WENT ON TO SAY THE WATER IS NOT POTABLE AND MUST BE TREATED, <br />AND THE INFORMATION HE HAS INDICATES THERE WILL BE NO SUBSTANTIAL <br />EFFECT ON THE SHALLOW WELL AQUIFER BY TAPPING INTO THE DEEP WELL <br />ACQUIFER. HE ALSO FELT THAT MR. CURTIN'S REPORT CONFLICTS SOMEWHAT <br />WITH THE DOT FIGURES. ATTORNEY HENDERSON COMMENTED THAT THE COUNTY'S <br />FRANCHISE ORDINANCE WOULD CONTROL IMPACT FEES, AND SINCE THIS IS A <br />CONDOMINIUM DEVELOPMENT, THERE IS NO WAY THAT THIS SYSTEM IS GOING <br />TO BE ALLOWED TO DETERIORATE TO A POINT THAT IT WILL NOT SERVE ITS <br />PEOPLE. HE THEN MADE AN AFFIRMATIVE STEP BY FORMALLY AMENDING THE <br />APPLICATION TO APPLY FOR A DESIGNATION OF R -2A WEST OF A -1-A. <br />ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER <br />LYONS, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />CHAIRMAN SIEBERT ANNOUNCED THAT SINCE THERE ARE ONLY FOUR <br />BOARD MEMBERS PRESENT TODAY, THERE IS A POSSIBILITY OF A TIE VOTE; IN <br />THE EVENT OF THIS, POSSIBLY THIS MATTER SHOULD BE TABLED UNTIL THE <br />FIFTH COMMISSIONER IS PRESENT. <br />
