A G R E E M E N T <br />THIS AGREEMENT, Made and entered into this o?9r'�'day of <br />September, 1980, by and among the BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, hereinafter referred to as "County"; <br />the TOWN COUNCIL OF THE TOWN OF INDIAN RIVER SHORES, FLORIDA, <br />hereinafter referred to as "Town"; and the SOUTH INDIAN RIVER COUNTY <br />FIRE DISTRICT, hereinafter referred to as "District"; and their <br />successors. <br />W I T N E S S E T H: <br />WHEREAS, on the 5th day of November, 1975 County and Town entered <br />into an Agreement for Joint Fire Protection, which Agreement included <br />certain rights to County _-o take over Town's fire fighting equipment <br />and lease certain portions of Town's Fred R. Tuerk Municipal Center; <br />and <br />WHEREAS, on the 5th day of January, 1977 County and Town re- <br />affirmed their November 5, 1975 Agreement and entered into additional <br />agreements concerning the eighty-five foot (851) standard equipped <br />aerial ladder truck; and <br />WHEREAS, by Case No. 78-764, Town, in August of 1978, filed <br />an action for Declaratory Decree requesting the Court to intepret <br />the validity of the two Agreements above referred; and <br />WHEREAS, County, by Ordinance No. 80-32 and properly joined <br />by City of Vero Beach Ordinance, created the SOUTH INDIAN <br />RIVER COUNTY FIRE DISTRICT,which District was approved and millage <br />authorized by the voters in a primary election held September 9, <br />1980; <br />NOW, THEREFORE, in consideration of mutual promises and other <br />covenants as set forth below the parties agree as follows: <br />1. A. County and Tonin agree to void and forever negate the <br />Joint Fire Protection Agreement entered into between Town and <br />County on the 5th day of November, 1975, and that Purchase of <br />Fire Protection Agreement dated the 5th day of January, 1977. <br />45' <br />OCT 2 21980 fudil <br />
