LINER TALKS ABOUT TELLING <br />THE <br />DEVELOPER WE DON'T HAVE ANY MORE CAPACITY AND RETURNING HIS MONEY <br />COULD PUT US IN A REAL PICKLE AND THAT IT IS NOT ACCEPTABLE. HE <br />STATED THAT HE WOULD LIKE TO SEE THE BOARD MANDATE THAT AFTER WE <br />REACH A CERTAIN POINT, NO DEVELOPER AGREEMENT WILL BE ENTERED INTO <br />WITHOUT SHOWING THERE IS ADEQUATE CAPACITY TO PROVIDE FOR THEIR <br />NEEDS UP TO THE EXTENT OF THE AGREEMENT. <br />CHAIRMAN SIEBERT AGREED AND FELT WE SHOULD REQUIRE THE <br />DEVELOPER TO BEAR THE COST OF THE DETERMINATION OF WHETHER OR NOT <br />THERE IS ENOUGH CAPACITY. <br />MR. LINER POINTED OUT THAT AS WE APPROACH THE NUMBER OF <br />UNITS WE KNOW WE CAN SERVICE, ANYONE WHO CAME IN FOR MORE GALLONS <br />THAN WE WOULD HAVE, WOULD BE TURNED DOWN. HE BELIEVED THAT WE <br />ALREADY HAVE THE MECHANISM TO DETERMINE THIS. HE NOTED THAT WITH <br />THE 600,000 GPD WATER ALLOCATION, WE CAN HAVE ABOUT 400 MORE UNITS <br />BEFORE WE HAVE OUR OWN PLANT IN OPERATION, AND AS WE GET CLOSE TO <br />THAT AMOUNT, WE COULD MODIFY THAT NUMBER ACCORDING TO ACTUAL EXPERIENCE <br />AND DEMAND, ADMINISTRATOR NELSON AGREED THAT THIS JUST INVOLVES <br />SIMPLE ARITHMETIC. <br />ENGINEER ROBBINS ASSURED THE BOARD THAT KEEPING UP WITH <br />THE BOOKS ON THE NUMBER OF UNITS AVAILABLE IS QUITE SIMPLE. <br />COMMISSIONER WODTKE POINTED OUT THAT THE SECOND PARAGRAPH <br />OF THE MEMO STATES THAT WHEN THE SYSTEM REACHES A DESIGN DEMAND OF <br />HO% OF MAXIMUM CAPACITY OF THE SYSTEM, A LIMITED RATE OF CONNECTION <br />WILL BE IMPOSED, AND ATTORNEY COLLINS INFORMED HIM THAT WE ARE CLOSE <br />TO THAT POINT RIGHT NOW. <br />ATTORNEY COLLINS SUGGESTED THAT A TIME BE SET, PERHAPS <br />THREE MONTHS, TO ADVERTISE IN THE PAPER THAT CONTIGUOUS SINGLE FAMILY <br />RESIDENCES WILL HAVE AN OPPORTUNITY TO APPLY, AND OTHER EXISTING <br />STRUCTURES; THEN AFTER THREE MONTHS, WE WOULD DRAW THE LINE AND SEE <br />HOW MUCH ADDITIONAL CAPACITY IS AVAILABLE AND THEN PUT IT OUT TO <br />DEVELOPERS TO THE EXTENT THAT WE CAN SERVICE. <br />m <br />
