DISCUSSION FOLLOWED ON REDRAFTING THE AGREEMENT TO INCLUDE <br />THE THINGS DISCUSSED, AND IT WAS FELT THAT FOR THREE MONTHS WE WOULD <br />SAY EXISTING CONTIGUOUS SINGLE FAMILY RESIDENCES CAN MAKE APPLICATION <br />AND OTHER EXISTING CONTIGUOUS STRUCTURES, AND IN THE SECOND THREE <br />MONTHS, WE WOULD CONSIDER ANYONE IN THAT SAME CATEGORY WHO DIDNIT <br />APPLY PREVIOUSLY, PLUS DEVELOPERS WHO COULD BE SERVICED, AND IF IN <br />THAT THREE MONTH PERIOD ALL THE CAPACITY IS USED UP, THERE WOULD BE <br />NO ADDITIONAL CONNECTIONS AVAILABLE FOR 6TH AVENUE. <br />ATTORNEY COLLINS AGREED THAT WAS A PROPER SEQUENCE AND <br />NOTED THAT PREFERENCE COULD BE GIVEN TO SEWER AND WATER CUSTOMERS, <br />COMMISSIONER WODTKE COMMENTED THAT, IN ESSENCE, WE WOULD <br />HAVE NO MORE SEWER CUSTOMERS, AND ATTORNEY COLLINS FELT THIS WAS NOT <br />NECESSARILY SO BECAUSE THERE ARE ALTERNATE WATER SUPPLIES AND THERE <br />IS NOTHING TO SAY WE COULDN'T HOOK THESE PEOPLE UP AS SEWER CUSTOMERS, <br />ALTHOUGH WE WOULD PREFER TO HAVE BOTH WATER AND SEWER. <br />COMMISSIONER WODTKE NOTED THAT THERE WONT BE ANY INDIVIDUALS <br />FOR WATER AND SEWER UNLESS THEY PUT IN LIFT STATIONS, AND SINGLE FAMILY <br />LIFT STATIONS ARENIT FEASIBLE. <br />DISCUSSION AROSE ABOUT TROPIC GROVES, AND THE ATTORNEY DID <br />NOT SEE HOW A PROJECT SUCH AS THAT CAN BE ADDRESSED UNTIL THE NEW <br />PLANT IS ON LINE. <br />AFTER FURTHER CONVERSATION, CHAIRMAN SIEBERT DIRECTED <br />UTILITY DIRECTOR LINER TO WORK WITH ATTORNEY COLLINS ON REDRAFTING <br />THE PRIORITY SYSTEM FOR WATER CONNECTION AS DISCUSSED. <br />WASTEWATER SERVICE AGREEMENT BETWEEN THE CITY OF VERO REACH, TOWN OF <br />INDIAN RIVER SHORES AND INDIAN RIVER COUNTY <br />COMMISSIONER LYONS REPORTED THAT PART OF THE AGREEMENT IS <br />THAT THE TOWN DISMISSES THE SUIT AGAINST THE COUNTY FOR SEWER SERVICE. <br />HE NOTED THE PERTINENT PART OF THE AGREEMENT IS FOUND STARTING AT <br />PARAGRAPH 6, WHICH SPECIFICALLY DESIGNATES THE AREAS TO BE COVERED, <br />INCLUDING THE "TRACKING STATION" AS SHOWN IN EXHIBIT "A"; HE FELT <br />THE NEXT THING OF SPECIFIC IMPORTANCE IS AT THE BOTTOM OF PARAGRAPH 7 <br />ON PAGE 3 WHERE THE CITY AGREES TO ACCEPT TITLE TO WASTEWATER FACILITIES. <br />LIFT STATION, ETC., ONLY AFTER CONDITIONS ARE FULLY COMPLIED WITH TO <br />THE SATISFACTION OF THE CITY. COMMISSIONER LYONS CONTINUED THAT <br />ORIGINALLY IT WAS PROVIDED THAT IF THE TOWN DID NOT CONSTRUCT THE <br />SpOK 45 PACE �73 <br />OCT 2 2 X980 �3 J <br />
