Oslo Road and 66th Avenue — Northeast Corner, Right -of -Way Purchase <br />and Dedication, Owner: Audrey Graves Sexton/Three Dogs & A Horse, <br />LLC & Audrey Graves Sexton Trust <br />(memorandum dated July 3, 2014) <br />38-51 <br />Approved the purchase of the needed right-of-way at a price of <br />$31,655, and authorized the Chairman to execute the Purchase and <br />Sale Agreement with Three Dogs & A Horse, LLC, and the Audrey <br />Graves Sexton Trust. <br />H. Release of Retainage for CB&I Coastal Planning and Engineering, Inc., <br />Work Order No. 2, Sector 3 Dune Repair — Design and Permitting Services <br />(memorandum dated July 3, 2014) <br />52-55 <br />Approved the release of all withheld retainage under Work Order No. <br />2 with CB&I Coastal Planning & Engineering, Inc., in the amount of <br />$5,738.74. <br />9:13 a.m. I. 66th Avenue Right -of -Way Acquisition, 7715 66th Avenue, Vero Beach, Fl <br />32967, Seller: Brian R. Hood <br />(memorandum dated July 8, 2014) <br />9:14 a.m. <br />9:19 a.m. <br />56-68 <br />Chairman O'Bryan noted that the lease agreement between the <br />County and Brian R. Hood, the seller of the property, allows Mr. Hood <br />to remain onsite rent-free for two years. He asked staff to ensure that <br />Mr. Hood will be required to pay market-based rent if there is a lease <br />extension beyond the stipulated two years. <br />Vice Chairman Davis wanted to make sure that the new condition <br />would not nullify the existing deal with Mr. Hood. <br />Discussion ensued about the eminent domain process and whether Mr. <br />Hood will be willing to sell his property with the new condition. <br />Director of Public Works Chris Mora affirmed that he would report <br />back to the Board if Mr. Hood rejects the new condition of the <br />sale/lease. <br />ON MOTION by Commissioner Solari, SECONDED by Vice <br />Chairman Davis, the Board unanimously: (1) approved the purchase <br />of the property and leaseback at 7715 66th Avenue, with Brian R. <br />Hood, at a total price of $282,000; and (2) authorized the Chairman to <br />execute the Purchase and Sale Agreement with Mr. Hood, with the <br />caveat to add wording in the lease agreement that future lease <br />extensions will be based upon market-based rental value. <br />Board of County Commission Minutes <br />July 15, 2014 Page 4 <br />
