9. CONSTITUTIONAL OFFICERS AND GOVERNMENTAL <br />AGENCIES <br />9.A. DERYL LOAR, INDIAN RIVER COUNTY SHERIFF - BUDGET <br />AMENDMENT <br />Sheriff Deryl Loar recalled that at the July 14, 2010 Budget Workshop, the Board <br />authorized him to transfer capital, expenses, and salaries, between categories. He asked the <br />Board approve his 2010/11 Operating Budget by transferring funds between categories in order <br />to maximize the use of the Budget funds for continued operation and strategic planning. <br />At the request of Chairman O'Bryan, Sheriff Loar agreed to provide an update or <br />informational notice after the 2011 Budget money has been transferred, for reasons of <br />transparency. The Sheriff revealed that he would also be providing a draft of his revised Budget <br />to show how reductions would be targeted. <br />MOTION WAS MADE by Commissioner Flescher, <br />SECONDED by Commissioner Davis, to approve the <br />Sheriff's request to amend his Fiscal Year 2010-2011 <br />Operating Budget by transferring funds between <br />categories (i.e. salaries, operating, and capital), as <br />requested in his letter dated July 23, 2010. <br />County Attorney Alan S. Polackwich, Sr. pointed out that the 2010/2011 Fiscal Year <br />Budget had not yet been adopted. He did not feel the Budget should be amended outside <br />Statutory Procedure 200.065, clarifying that Florida law allows expenditures within the funds of <br />the Sheriff's Budget to be increased or decreased by Motion, and recorded within the minutes, <br />and he believed the Sheriff was asking for the authority to exercise this right. <br />22 <br />August 17, 2010 <br />
