Community Planning Director Stan Boling, through a PowerPoint presentation (on file), <br />explained the right-of-way abandonment request from Macedonia Baptist Church, and <br />recommended the Board grant the request with two conditions: (1) that the applicant file a Unity <br />of Title for Lots 61 through 63 of Lincoln Park Estates, and (2) the County retain a drainage and <br />utility easement over the south 25 feet of right-of-way segment. <br />The Chairman opened the Public Hearing. There being no speakers, the Chairman closed <br />the Public Hearing. <br />ON MOTION by Commissioner Davis, SECONDED by <br />Commissioner Flescher, the Board unanimously approved <br />Resolution 2010-066, providing for the closing, <br />abandonment, vacation and discontinuance of a segment <br />of 44th Street lying between 30th Avenue and the Lateral H <br />Canal as shown in Plat Book 2, Page 77 and Plat Book 2, <br />Page 88 of the Public Records of Indian River County, as <br />described herein, said land now lying in Indian River <br />County, Florida. Conditions include: (1) prior to the <br />abandonment resolution being recorded, the applicant <br />shall provide the County with a recorded unity of title for <br />Lots 61-63 Lincoln Park Estates; and (2) a 25' wide <br />drainage and utility easement shall be retained over the <br />south 25' of the subject right-of-way segment. <br />24 <br />August 17, 2010 <br />
