ATTORNEY COLLINS COMMENTED THAT THERE IS A SITE PLAN ON <br />FILE FOR 11 UNITS, BUT THE POTENTIAL FOR DEVELOPMENT ON THE LAND <br />FAR EXCEEDS THE THRESHOLD OF 750 UNITS; AND THE PLANNING DEPARTMENT <br />HAS REPRESENTATIONS FROM THE DEVELOPER THAT HE IS GOING TO DEVELOP <br />AT A DENSITY THAT IS LESS THAN THE THRESHOLD - BUT THERE ARE NO <br />GUARANTEES OF THAT FACT. HE ADDED THAT MR. REVER IS CONCERNED THAT <br />BY PROCESSING PART OF THE APPLICATION, HE, IN EFFECT, WOULD VEST THE <br />ENTIRE PROJECT. THE ATTORNEY COMMENTED THAT MR. REVER HAS TAKEN <br />THE POSITION THAT THERE IS THE POTENTIAL FOR DENSITIES IN EXCESS <br />OF THE THRESHOLD, THEREFORE, A DRI SHOULD BE OBTAINED, BUT HE HAS <br />ALSO SAID THAT THE DEVELOPER CAN AVOID OBTAINING THE DRI IF HE GETS. <br />A BINDING LETTER FROM THE STATE SAYING THAT THE PROJECT IS NOT, IN <br />FACT, A DRI. THAT SUMMARIZES WHAT THE COUNTY'S POSTURE IS, AND WHY <br />THE PLANNING DEPARTMENT HAS TAKEN THE POSITION THAT IT HAS. <br />CHAIRMAN LYONS REFERRED TO ITEM 11D SCHEDULED LATER IN THE <br />DAY, AND HE STATED HE HAD A NUMBER OF SUGGESTIONS CONCERNING THE <br />BARRIER ISLAND. HE ADDED THAT THIS MIGHT'GIVE THE DEVELOPER A POSITIVE <br />SIGNAL SO THAT HE CAN PLAN ACCORDINGLY, AND THE CHAIRMAN WAS HOPEFUL <br />THAT THE BOARD COULD COME UP WITH A SPECIFIC PLAN REGARDING THE <br />DENSITY TODAY. <br />COMMISSIONER FLETCHER INQUIRED IF FLORIDA LAND COMPANY, IN <br />ANY OF THEIR DEVELOPMENTS, HAS EVER GONE THROUGH A DRI. <br />ATTORNEY HENDERSON ADVISED THAT THEY DID FOR THE BENT PINE <br />DEVELOPMENT IN 1973. <br />DISCUSSION FOLLOWED ABOUT THE VARIOUS ALTERNATIVES PRESENTED <br />TO THE BOARD. <br />COMMISSIONER SCURLOCK COMMENTED THAT HE WAS NOT IN FAVOR OF <br />SEEKING THE ATTORNEY GENERALS OPINION. <br />CHAIRMAN LYONS ALSO COMMENTED THAT HE PLANNED TO VOTE <br />AGAINST GETTING THIS OPINION. <br />COMMISSIONER SCURLOCK INQUIRED IF FLORIDA LAND COMPANY <br />OWNED THE BEACH COLONY AND RIVER BEND PROPERTY. <br />ATTORNEY HENDERSON ADVISED THAT THEY HAVE OPTIONS ON THE <br />PROPERTY; THE APPLICANT IS ACTING AS AN AGENT, <br />DEC 31980 13 soak 45 PA*GE 345 <br />
