The applicable county or state standards must be <br />satisfied. <br />(5) Wetlands regulations. Wetlands regulations restrict or <br />prohibit development within wetland areas, which generally <br />consist of water bodies, impoundments, or areas inundated by <br />water for a period of time. Wetlands may be close to or <br />connected to a waterbody or "isolated". Generally, the <br />following activities within wetlands are subject to <br />regulations and restrictions [restated from Chapter 928, <br />Wetlands and Deepwater Habitat Protection]. <br />(a) No activity shall be allowed that results in the <br />alteration, degradation, or destruction of wetlands or <br />deepwater habitats except when: <br />1. such an activity is necessary to prevent or <br />eliminate a public hazard, provided wetland and <br />deepwater habitat functional loss is unavoidable <br />and minimized; <br />2. such an activity would provide direct public <br />benefits which would exceed the loss of wetland or <br />deepwater habitat functions and values, provided <br />there is a public need, nd wetland and deepwater <br />habitat functional loss is unavoidable and <br />_ minimized; or <br />3. such an activity is proposed for wetlands or <br />deepwater habitats in which the functions and <br />values currently provided are significantly less <br />than those typically associated with such habitats <br />and cannot <br />be reasonably restored, and preservation of the <br />habitat is not in the public interest. <br />(b) Mitigation shall be required for any activity that <br />results in the alteration, degradation, or destruction <br />of wetlands or deepwater habits, as provided for in <br />chapter 928. <br />(6) Tree protection, tree removal, and land clearing regulations. <br />Tree protection, tree removal., and land clearing regulations <br />can affect the development and maintenance of single family <br />parcels. <br />(a) Mangroves <br />vegetation <br />without a <br />division. <br />and dune (Atlantic Ocean beach area) <br />may not be removed, cleared, or trimmed <br />special permit issued by the planning <br />250 <br />
