setback areas shall be approved by the <br />public works director. <br />II. Where the applicant's project is <br />considered a minor site plan under the <br />terms of this ordinance, the applicant <br />may in lieu of dedication or sale <br />increase the building setbacks needed to <br />accommodate right-of-way deficiencies. <br />3. Dedication of Minor (local) Road Right -of -Way <br />Any applicant for approval for a project abutting a <br />public or private roadway classified as a minor (local) <br />road by the terms of the county traffic circulation <br />element shall dedicate sufficient land to make up his <br />share of the road right-of-way deficiency. There shall <br />be no compensation given for the dedication of minor <br />(local) road right-of-way. The public works director or <br />his designee may accept drainage and utility easements <br />in lieu of right-of-way, to make-up for small (up to <br />10') right-of-way deficiencies. <br />(4) Access and Driveway Regulations. <br />(a) Any application to construct a single family residence <br />shall include the location of the driveway(s). Said <br />driveway shall provide access to the residence and to <br />the off-street parking area(s). <br />1. For any single family residence proposed to be <br />constructed, the driveway(s) shall have a minimum <br />width of eleven (11) feet in the area where the <br />driveway is within the right-of-way. <br />(b) On single family parcels having frontage on more than <br />one roadway, access shall be restricted to the roadway <br />having the lower functional classification. <br />1. Where new residences are constructed or carports or <br />garages are constructed on single-family parcels <br />where access is restricted as provided in 4.(b) <br />above, garages and carports shall be designed and <br />oriented so as to be accessed by legal, conforming, <br />and approved driveways. <br />2. Right-of-way permits are required for connecting a <br />driveway(s) to either a county or a state road. <br />249 <br />
