in which case, the entire road right-of-way <br />deficiency will be made up by acquisition of <br />land from the project site. <br />b. Applicants for projects located on roadways <br />where right-of-way deficiencies exist shall <br />bring the abutting road (local, collector, or <br />arterial) right-of-way up to local (minor) <br />road standards as defined in the traffic <br />circulation element. Said dedications are <br />deemed site related and necessary to serve the <br />proposed development itself and shall not be <br />creditable for compensation. <br />2. Dedication of Thoroughfare Plan Road Right -of -Way <br />Any applicant for approval of a project abutting a <br />roadway designated on the county thoroughfare plan <br />map where the roadway has a road right-of-way <br />deficiency shall sell to the county sufficient land <br />to make up his share of the road right-of-way <br />needed for non -site related improvements. The <br />applicant shall receive, through traffic impact fee <br />credits, or residential density transfers, or <br />direct payments where the county chooses to pay <br />cash, or any combination or other acceptable means <br />of compensation, one hundred (100) percent <br />compensation for the value of the undeveloped <br />condition of the land area dedicated for road <br />right-of-way, which exceeds any area needed to <br />bring the right-of-way up to county local (minor) <br />road standards. Where the county is to purchase <br />land for future right-of-way, the county shall <br />compensate the property owner based upon the <br />"undeveloped condition" of the land. This <br />compensation shall be agreed upon prior to project <br />approval, and the purchase shall occur prior to <br />issuance of a certificate of completion or a <br />certificate of occupancy for the project. <br />a. Exemptions <br />I. Where one hundred (100) percent <br />compensation cannot be provided through <br />traffic impact credit and density <br />transfers, and where the county chooses <br />not to pay cash, the applicant shall <br />dedicate an amount of land comparable in <br />value to the percent of compensation <br />provided, and the applicant shall be <br />encouraged to setback the balance of the <br />right-of-way deficiency; the location and <br />configuration of said dedication and <br />248 <br />
