65th St. <br />49th St. <br />33rd St. <br />8th St. <br />13th St. S.W. <br />61st St. <br />45th St. <br />26th St. <br />1st St. S.W. <br />21st S.W. <br />57th St. <br />37th St. <br />16th St. <br />5th St. S.W. <br />The following right-of-way regulations apply to the <br />development of new single family homes (included in the term <br />"projects") in the following restated section from chapter <br />952 of the Traffic ordinance. <br />(a) Right of Way Dedication or Acquisition. For all <br />projects requiring an Indian River County development <br />order, the land lying within the proposed development <br />which is necessary to widen or extend roadways to the <br />standards designated in the Indian River County <br />Thoroughfare Plan and implementing Right-of-way Width <br />table, or to provide adequate land area for utilities, <br />sidewalks and/or bikepaths shall be transferred to the <br />county as specified in this section, by the applicant <br />prior to the release of the site plan, preliminary plat <br />approval, or building permit issuance, as appropriate. <br />The county shall compensate the property owner for the <br />right-of-way transfer unless the right-of-way is needed <br />because of a site related impact. <br />1. General Requirements <br />a. An applicant for approval of a project <br />abutting a roadway which has an existing road <br />right-of-way deficiency shall transfer right- <br />of-way needed for site related roadway <br />improvements for that segment of the roadway <br />abutting the project, and shall enter into a <br />purchase contract or similar agreement with <br />the county to sell needed right-of-way for <br />future non -site related improvements, prior to <br />release of the approved site plan for the <br />project. Wherever a road right-of-way <br />deficiency exists, the deficiency shall be <br />made up by acquisition of equal amounts of <br />land from each side of the existing right-of- <br />way, except where: <br />I. A drainage district canal right-of-way or <br />a railroad right-of-way abuts one side of <br />the existing road right-of-way; or <br />II. At least one-half of the required road <br />right-of-way has been provided by the <br />property on the opposite side of the <br />existing road right-of-way; <br />247 <br />
