(a) As part of the building permit application, the property <br />owner submits a notarized letter stating that: <br />- at no time will more than one dwelling be occupied <br />on the parcel <br />- no certificate of occupancy (C.O.) will be <br />requested for the new house until a permit to raze <br />the older house is obtained and an agreement is <br />executed by the property owner, guaranteed by <br />posted security, that the older house will be razed <br />within forty-five (45) days after the issuance of <br />a C.O. for the new house. <br />(b) No C.O. shall be issued for the new house until a permit <br />to raze the older house is obtained and an agreement is <br />executed by the property owner, guaranteed by posted <br />security, in an amount equal to 115% of the cost to raze <br />the house and remove and dispose of all debris, <br />committing the owner to having the older house razed and <br />all trash materials and debris removed from the parcel <br />within forty five (45) days of the date of issuance of <br />a C.O. for the new house. The agreement and posted <br />security shall be in a form deemed legally sufficient by <br />the County Attorney's Office. <br />Section 912.14 Fences and Walls <br />No walls or fences may be erected or replaced without first <br />obtaining a permit issued by the building division. <br />(1) Location. Generally, walls and fences cannot be placed or <br />replaced within road rights-of-way or within any type of <br />easement. <br />(a) Subject to easements and height restrictions specified <br />herein, walls and/or fences may be located up to a <br />property line, or along a property line if a common <br />easement exists among adjacent property owners that <br />allows for the "sharing" of a wall and/or fence. <br />(b) Height of walls and Fences. <br />1. Front Yard. Fences not exceeding forty-eight (48) <br />inches in height may be erected in the front yard <br />of any lot. <br />2. Side Yard. Fences not exceeding six (6) feet in <br />height may be erected in the side yard of any lot <br />provided they do not extend beyond the front <br />setback line. <br />259 <br />
