Such facilities may also provide other <br />services,such as transportation for routine social and medical <br />appointments, and counseling. <br />Conservation Areas - Real property supporting a natural area or <br />areas protected via the filing of a conservation easement, whereby <br />such areas are preserved in viable condition with intact canopy, <br />understory, and groundcover, as applicable. Conservation areas are <br />generally established in accordance with the requirements of <br />Chapter 928, Wetlands and Deepwater Habitat Protection, and Chapter <br />929, Upland Habitat Protection. Such areas include freshwater and <br />estuarine wetlands, and upland plant communities such as coastal <br />strand, hardwood hammocks, xeric -scrub, coastal/tropical hammocks, <br />pine flatwoods, and dry prairies. <br />Conservation areas are allowed as credit toward other county land <br />development regulations such as landscape, buffer, and open space <br />requirements, and minimum yard setback requirements. Certain <br />activities, such as passive recreation, may be allowed in <br />conservation areas provided the activities are not detrimental to <br />the health of the ecological system. <br />Conservation Easement - An easement granting a right or interest <br />in real property that is appropriate to retaining land or water <br />areas predominately in their natural, scenic, open, or wooded <br />condition; retaining such areas as suitable habitat for fish, <br />plants, or wildlife; or maintaining existing land uses. <br />Consistent with the Indian River County Comprehensive Plan - A <br />determination that the land uses, densities or intensities and <br />other aspects of development permitted by a development order are <br />compatible with and further the goals, objectives, policies, land <br />uses, and densities or intensities in the Indian River County <br />Comprehensive Plan. <br />Constrained Facility - A roadway segment on the Concurrency <br />Determination Network that is currently backlogged or projected to <br />be backlogged due to the inability to expand the facility because <br />of environmental concerns, inability to economically obtain <br />required right-of-way, or community policies about the extent of <br />road widening considered to be acceptable without undue degradation <br />of neighborhood character. <br />Construction - The building of or substantial improvement to any <br />structure or the clearing, filling, or excavation of any land. It <br />shall also mean any alterations in the size or use of any existing <br />structure or the appearance of any land. When appropriate to the <br />context, "construction" refers to the act of construction or the <br />result of construction. <br />Construction (Start of) - Any on-site activity including land <br />clearing, earth moving, or the erection of structures. "Start of <br />construction" includes substantial improvement, and means the date <br />the building permit was issued, provided the actual start of <br />constructing, repair, reconstruction, placement, or other <br />improvement was within one hundred eighty (180) days of the permit <br />23 <br />
