REVER COULD NOT'SAY DEFINITELY, HE STATED THAT IT WAS <br />THEIR THINKING WHEN THIS WAS PRESENTED THAT, SINCE WE DID NOT REQUIRE <br />A ROAD, THE 15' RIGHT OF WAY WOULD SERVE THE SAME PURPOSE AS A UTILITY <br />EASEMENT RATHER THAN REQUEST AN ADDITIONAL EASEMENT FURTHER -WEST, <br />ATTORNEY COLLINS NOTED THAT GENERALLY A ROAD RIGHT OF WAY <br />IS JUST THAT AND NOT A UTILITY RIGHT OF WAY, BUT IT IS THE COUNTY'S <br />RIGHT OF WAY AND HE FELT THEY COULD DETERMINE TO USE IT THAT WAY, <br />ATTORNEY PALMER AND MR, ZORC BOTH EMPHASIZED THAT IT WAS <br />THE PLANNING DEPARTMENT'S RECOMMENDATION THAT THIS DEVELOPMENT HAVE <br />TWO ACCESS ROADS, <br />CHAIRMAN LYONS ASKED FOR A MOTION APPROVING THE PLAT SUBJECT <br />TO WHATEVER CONDITIONS THE BOARD WISHED TO INCLUDE. <br />COMMISSIONER BIRD RECOMMENDED AN ADDITIONAL 35' OF BUFFER <br />BE LEFT TO THE WEST OF THE PROPOSED PLAT AND THE FENCE BE PLACED AT <br />THAT POINT. <br />ATTORNEY PALMER REVIEWED THE PRESENT REQUIRED 25' SETBACKS, <br />WHICH PLUS THE 15' STRIP EQUALS 65', AND HE DID NOT FEEL THE BOARD <br />HAD THE AUTHORITY TO REQUIRE AN ADDITIONAL 35' OFF ALL THE WESTERN <br />LOTS OR TO DENY ACCESS TO A PUBLIC ROAD. <br />MS, CHARLOTTE.MITCHELL FELT THAT THE BOARD IN TALKING ABOUT <br />BUFFERS WAS AVOIDING THE MAIN ISSUE, WHICH IS THAT THIS PROPERTY IS <br />SURROUNDED BY ONE FAMILY DWELLINGS AND THERE WOULD BE A MASS OF PEOPLE <br />IN THE MIDDLE OF A SINGLE FAMILY AREA, <br />ATTORNEY GREEN AGAIN RECOMMENDED THAT THE COMMISSION REJECT <br />THE PRELIMINARY PLAT AND HAVE IT RESUBMITTED INCORPORATING THE SUGGES- <br />TIONS MADE TODAY, <br />MOTION WAS MADE BY COMMISSIONER FLETCHER, SECONDED BY COM- <br />MISSIONER BIRD, TO REJECT THE PRELIMINARY PLAT OF COLONIAL HEIGHTS <br />SUBDIVISION AS PRESENTED WITH RECOMMENDATION TO MR. ZORC TO COMPLY <br />WITH THE SUGGESTIONS MADE TODAY - TO ELIMINATE ACCESS TO STH STREET; <br />TO HAVE ONE ACCESS TO OLD DIXIE; TO INCLUDE THE SETBACKS AND EASEMENTS <br />MENTIONED, INCLUDING SETBACKS FOR LANDSCAPING AND FENCING. <br />ATTORNEY PALMER ASKED IF COMMISSIONER BIRD IN RECOMMENDING <br />35', ACTUALLY MEANT AN ADDITIONAL 10' SINCE THERE ALREADY WAS A 25' <br />SETBACK. <br />
