COMMISSIONER BIRD STATED THAT HE MEANT 35° ADDITIONAL, EVEN <br />THOUGH HE REALIZED THAT THIS MEANT THEY WOULD HAVE TO REDESIGN AND <br />POSSIBLY LOSE SOME LOTS, HE AGREED A FENCE IS HARD TO SPECIFY, BUT <br />FELT IT WOULD BE DESIRABLE. <br />CHAIRMAN LYONS POINTED OUT THAT IF MR. ZORC PUT A FENCE ON <br />HIS PROPERTY AS SUGGESTED BY COMMISSIONER BIRD, HE WOULD BE FENCING <br />OUT 601 OF HIS PROPERTY TO BE USED BY PEOPLE IN THE OTHER SUBDIVISION, <br />COMMISSIONER BIRD AGREED THE FENCE SHOULD BE ON THE OTHER <br />SIDE OF THE BUFFER. <br />MR. ZORC AGAIN REQUESTED THAT -THE BOARD CONSIDER THE FACT <br />THAT THEY DID BUY THE PROPERTY IN GOOD FAITH FOR USE OF THAT ZONING, <br />AND HE POINTED OUT THAT THE SETBACKS NOW BEING DISCUSSED WOULD MAKE IT <br />SO THEY COULDN`T USE THOSE LOTS. HE CONTINUED THAT HIS INVESTORS <br />f <br />MIGHT CONSIDER A COMPROMISE TO RESTRICT THE WESTERLY LOTS OF THEIR <br />SUBDIVISION TO HALF OF THE DENSITY OF THE REST OF THE SUBDIVISION, <br />ADMINISTRATOR NELSON NOTED THAT HALF THE DENSITY WOULD BE <br />ONE UNIT PER LOT, AND MR, ZORC STATED THEY WOULD GO TO ONE UNIT ON <br />THOSE LOTS. <br />ATTORNEY GREEN FELT MR, ZORC COULD HAVE A DEED RESTRICTION <br />AND BELIEVED THE BOARD SHOULD REJECT THE PLAT AND LET MR. ZORC RESUBMIT. <br />MR, ZORC ASKED THE BOARD TO CONSIDER THAT HE IS HERE FOR <br />THE THIRD TIME. HE BELIEVED THE PROBLEM COULD BE SOLVED IF THEY <br />CHANGED THESE LOTS TO SINGLE FAMILY, OR HALF THE DENSITY OF THE REST <br />OF THE SUBDIVISION. HE NOTED THESE LOTS THEN WOULD BE AS BIG OR BIGGER <br />THAN THOSE IN COLONIAL TERRACE. <br />IT WAS NOTED THIS WOULD BE ONE SINGLE FAMILY HOMESITE ON <br />EACH 1/2 ACRE LOT ABUTTING COLONIAL TERRACE, AND MR, ZORC STATED THAT <br />WOULD BE IF THEY ARE ON SEPTIC TANK AND WELLS; IF THEY ARE ON A WATER <br />SYSTEM, IT WOULD BE DIFFERENT, <br />COMMISSION FLETCHER BELIEVED THAT IS A GOOD OFFER IF IT IS <br />-NOT MADE CONTINGENT ON WATER AND SEWER. <br />MR. ZORC.THEN AGREED THAT HE WOULD NOT MAKE HIS OFFER CON- <br />TINGENT ON ANYTHING, AND HE WOULD AGREE TO NO MORE THAN ONE SINGLE <br />.' <br />JAN 141991 <br />
