January 6, 1981 <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: County Administrator <br />SUBJECT: Pinecrest Subdivision <br />Based upon the certification of Ed Schmucker, Total <br />Development, Inc. dated December 23, 1980 and the subsequent <br />inspection of Pinecrest Subdivision by the Assistant Adminis- <br />trator, Harold McCormick, it is recommended that the $5000.00 <br />bond posted to insure completion of this subdivision be <br />returned. <br />The developers will be required to maintain the streets, <br />signs and ditches for one year priorto acceptance by the <br />County. <br />Neil A. I?elson, County Administrator <br />ADMINISTRATOR NELSON REPORTED THAT THE DEVELOPER HAS COM- <br />PLETED THE.GRADING AND SEEDING OF THE SWALES, BUT HE LEARNED TODAY <br />THAT THE SHRUBBERY PLANTED IN PINECREST SUBDIVISION TO SCREEN THEIR <br />WATER PLANT HAS DIED AND NEEDS TO BE REPLANTED. HE WONDERED IF WE <br />COULD RELEASE THE $5,000 SUBJECT TO REPLANTING OF THIS SHRUBBERY, <br />COMMISSIONER FLETCHER DID NOT FEEL THEY WOULD BE AS LIKELY <br />TO DO THE REPLANTING IF THEY HAD ALREADY BEEN REIMBURSED THE $5,000, <br />AND ADMINISTRATOR NELSON SUGGESTED THAT WE COULD RELEASE IT ONLY <br />PARTLY AT THIS TIME, <br />DISCUSSION ENSUED AS TO SOME KIND OF GUARANTY TO INSURE <br />THAT PLANTINGS ARE ADEQUATE AND WILL SURVIVE. COMMISSIONER WODTKE <br />FELT THERE SHOULD BE SOME PROVISION MADE IN THE FRANCHISE TO THIS <br />EFFECT SO THAT IF THIS IS NOT PROPERLY DONE, THEY WOULD BE IN VIOLATION <br />OF THEIR FRANCHISE. <br />ATTORNEY COLLINS STATED THAT THIS IS IN THE FRANCHISE, BUT <br />HE -STILL FELT THE BOARD IS IN A BETTER POSITION WITH THE MONEY IN HAND. <br />JAN 141981 75 <br />Bx!
