JAN 14 19814� �� <br />Box E- 54 <br />COMMISSIONER SCURLOCK ASKED IF WE HAVE ANY PROVISION FOR AN <br />ANNUAL REVIEW OF FRANCHISE AGREEMENTS TO SEE IF THEY ARE IN COMPLIANCE. <br />IN FURTHER DISCUSSION, IT WAS FELT THAT THE UTILITY DIRECTOR WOULD <br />BE THE LOGICAL PERSON TO DESIGNATE TO CARRY THIS OUT. <br />ADMINISTRATOR NELSON SAW NO PROBLEM WITH COMING UP WITH <br />AN ANNUAL EVALUATION, AND CHAIRMAN LYONS DIRECTED THAT IN THE MONTH <br />OF ,JUNE OF EACH YEAR, THE UTILITY DIRECTOR WILL MAKE AN ANNUAL REPORT <br />TO THE BOARD ON EVALUATION OF FRANCHISES. <br />THE BOARD CONTINUED TO DISCUSS THE REPLANTING DESIRED IN <br />PINECREST SUBDIVISION AND THE NEED TO REMIND THE DEVELOPER OF HIS <br />OBLIGATION UNDER THE FRANCHISE TO MAINTAIN THE SHRUBBERY, <br />ON MOTION BY COMMISSIONER BIRD, SECONDED BY COMMISSIONER <br />SCURLOCK, THE BOARD UNANIMOUSLY AGREED TO RETAIN THE $5,000 BOND <br />POSTED BY PINECREST SUBDIVISION UNTIL THE DEVELOPER REPLANTS AS PER <br />THE ORIGINAL AGREEMENT; THE ADMINISTRATOR TO MAKE AN INSPECTION AT <br />THE EXPIRATION OF 90 DAYS TO INSURE THAT THE PLANTS ARE DOING SATIS- <br />FACTORILY; AND THE MONIES TO BE RETURNED AT THAT TIME UPON APPROVAL <br />OF THE ADMINISTRATOR. <br />JOHN COLLINS, RESIDENT OF THE AREA, INFORMED THE BOARD <br />THAT THE INADEQUATE PLANTING IS NOT THE ONLY WAY IN WHICH THE BUILDER <br />HAS VIOLATED THE TERMS OF HIS AGREEMENT WITH THE COMMISSION. HE CON- <br />TINUED THAT ABOUT 1-1/2 YEARS AGO, THE COMMISSION VOTED THAT MITCHELL <br />BUILDERS COULD NOT BREAK THROUGH AND USE THE ROADS OF COLONIAL TERRACE, <br />AND THEY HAVE FLOUTED THIS REQUIREMENT OF THE COUNTY COMMISSION ALSO. <br />MR. COLLINS, THEREFORE, ASKED THAT THE COMMISSION AMEND THEIR iMOTION <br />OR MAKE ANOTHER ONE TO REQUIRE MITCHELL BUILDERS TO ERECT A BARRICADE <br />AT THEIR EXPENSE COMPLETELY ACRESS THE END OF LOTH COURT, HE NOTED THAT <br />THE BARRICADE ON 11TH COURT HAS WORKED WELL. <br />ADMINISTRATOR NELSON FELT TtiE COUNTY MIGHT HAVE TO PUT SOME <br />LARGE STOP SIGNS ON EACH SIDE OF THE BARRICADE TO ALLEVIATE OUR LIA- <br />BILITY, BUT MR. COLLINS NOTED THAT THERE WILL BE A CUL DE SAC THERE AND <br />HE DID NOT FEEL IT WILL PRESENT A PROBLEM. <br />
