191 <br />JAN 28 soax 45 Pg� 772 <br />r following shall constitute the terms and conditions covered by this <br />Lease Agreements <br />A. CONSTRUCTION OF IMPROVEMENTS BY LESSEE <br />The Lessee will construct a housing facility which is to provide <br />living space to minors who ares <br />a. Between the ages of five (5) and fifteen (15) years, and, <br />b. Whose parents and/or legal guardians reside in Indian River <br />County, Florida, or minors whose Mediate past parents and/ <br />or guardians resided in Indian River County, Florida, and, <br />c. Who have been adjudicated Dependant pursuant to the laws of <br />the State of Florida, or, It <br />d. Who meet the criteria of above paragraphs A and B, and <br />whose problems are similar to those of adjudicated <br />Dependants. <br />The construction of said housing facility shall includes <br />a. Recreational facilities, <br />b. A substantial heavily wooded, landscaped outdoor area, if at <br />all possible. <br />c. In constructing all improvements on the site, lessee shall <br />leave as many trees as possible. <br />The said Lessee will handle such construction, at its sole cost, <br />in compliance with all applic'-ible permits and authorization, and building <br />and zoning lavas in compliance with ail other laws, ordinances, orders, <br />rules, regulations and requirements of all.Federal, State and Municipal <br />Governments. The said land will at all times be kept free of liens, as <br />4 result of such construction and installation (except in the mortgage <br />1 <br />or mortgages hereinafter authorized) for services performed and tabor <br />and materials supplied, or claimed to have been supplied thereto; and <br />the Lessee will not install any personal property within said improvements <br />under chattel mortgages, conditional bills of sale, or other title <br />retention instruments. <br />The Lessee will maintain Workmen's Compensation insurance at its <br />sole expense, covering all persons employed in construction and <br />installation of said project and with respect to whom death or bodily <br />injury claims could be asserted, against the Lessor or Lessee or the <br />-2- <br />
