said parcel of land and it will maintain, at its sole expense, <br />general liability insurance for the mutual benefit of the Lessee <br />and the Lessor with reasonable limits to be determined by the Lessor, <br />at all times when such construction is in progress. <br />The period of time within which the construction of said facility <br />must be completed by the Lessee will be enlarged by any delays caused <br />without fault or neglect on the part of the Lessee by acts of God, <br />strikes, lockouts# or any other conditions which are not attributable <br />to, or not caused by the Lessee's default or neglect to exercise due <br />diligence. The Lessee shall commence construction not later than <br />one year from the dateof this Lease, and shall proceed with the completion <br />thereof within one (1) year. <br />It is acknowledged that this Lease may be subject to a first <br />mortgage which will' encumber the leasehold interest and improvements <br />on the demised property from the Lessee to a lending institution, <br />which mortgage is to be used for financing the construction of the <br />facility to be erected thereon, and the Lessor agrees to execute such <br />instruments as are necessary to effect such construction mortgage, <br />provided,; however, that any such mortgage or encumbrance will, in all <br />respects, be subject to and subordinate to the rights of the Lessor <br />herein and to the rights of all persons claiming by, through or under <br />the Lessor by reason or in connection with this Lease. <br />Nothing in this Lease will ever be construed as empowering the <br />Lessee to encumber.or cause the Lessor to encoumber the title or interest <br />of the Lessor. <br />The Lessor's lien 4n this Lease will be subject and �ubordinate•to <br />the lien of any mortgage made by any lending institution provided that <br />the proceeds of such mortgage are utilized in their entirety for the <br />erection of the project which has been declared as the subject to this <br />property. llowever# the foreclosure of any such mortgage will not terminate <br />this lease or any part thereof or extinguish or diminish the rights of <br />the Lessor in and to the property covered by this Lease by the foreclosed <br />mortgage.
