JAN 28 1981 Box 45 P�,rE- <br />H. The CONSULTANT shall at all times carry, on all operations here- <br />under, workman's compensation insurance, public liability and property damage <br />insurance, and automotive public liability and property damage insurance. <br />I. It is understood and agreed that the CONSULTANT'S services under <br />this Agreement do not include participation, whatsoever, in any litigation. <br />Should such services be required, a supplemental agreement may be negotiated <br />between the COUNTY and the CONSULTANT describing the services desired and <br />providing a basis for compensation to the CONSULTANT. <br />J. The COUNTY and the CONSULTANT each binds itself and its successors, <br />legal representatives, and assigns to the other party to this Agreement and to <br />the partners, successors, legal representatives, and assigns of such other <br />party, in respect to all covenants of this Agreement; and, neither the COUNTY <br />nor the CONSULTANT will assign or transfer its interest in this Agreement with- <br />out the prior written consent of the other. <br />K. No officer or employee of the COUNTY and no member of its governing <br />body shall participate in any decision relating to this contract which affects <br />his personal interest or have any personal or pecuniary interest, direct or <br />indirect, in this contract or the proceeds thereof. <br />L. No reports, maps or other documents produced in whole or in part <br />under this contract shall be the subject of an application for copyright by or <br />on behalf of the CONSULTANT. <br />M. The COUNTY represents that it is a political subdivision of the <br />State of Florida with the authority to engage the professional services des- <br />cribed in Attachment B and accept the obligation to pay for such services <br />under the provisions of Attachment C. <br />V. COMPENSATION <br />The CONSULTANT shall be compensated for all services rendered under this Agree- <br />ment in accordance with the provisions of Attachment C. <br />VI. PROHIBITION AGAINST CONTINGENT FEES <br />The CONSULTANT warrants that it has not employed or retained any company or <br />person, other than a bona fide employee working solely for the CONSULTANT, to <br />solicit or secure this Agreement, and that it has not paid or agreed to pay <br />any persons, company, corporation, individual or firm, other than a bona fide <br />employee working solely for the CONSULTANT, any fee, commission, percentage, <br />gift, or any other consideration, contingent upon or resulting from the award <br />or making of this Agreement. <br />
